Dear Mr. Cook,
The MBTA is in receipt of your request for public records dated November 12, 2023 regarding the above-referenced matter; this request was received by our Records Access Officer on November 12, 2023.
Due to the volume of documents that must be reviewed in order to provide you with a full response, I write to you to discuss how your request might be modified to provide for a more affordable and efficient response. See G.L. c. 66, §10(b)(vii) (a records access officer may suggest a reasonable modification of the scope of the request or offer to assist the requestor to modify the scope of the request if doing so would enable the agency to produce records sought more efficiently and affordably). During our initial search, and in an attempt to comply with your request, it has been determined that based on your initial request the amount of records is beyond the basic purpose and intent of the public records law. "A requester does not need absolute precision, but an agency is entitled to more than a general category of what may be thousands of documents." See The David Project, Inc. v. Boston Redevelopment Authority, 22 Mass.L.Rep. 361 (2007). Our preliminary search has generated over 169,000 emails, each of which would require individual review to delineate the specific subject matter you are looking for. Under the Public Records Law “[t]he reasonable description requirement contemplates that a requesting party will identify documents or categories of documents with sufficient particularity that government employees will be able to understand exactly what they are looking for, and then make a prompt production.” Jaideep Chawla v. Dep't of Revenue, Suffolk. Sup. No. 1784CV02087, at 2 (January 23, 2019). “Requests for documents that are articulated with very broad language that calls upon non-lawyer administrative personnel to interpret the scope of what is sought, and then make fine judgments about what documents are and are not sufficiently ‘related’ to the category of materials requested, will not satisfy this statutory standard.”

I am writing in response to your December 6, 2023 communication sent to MassDOT relating to the narrowing of the scope of your request for email communications as stated above. Please note, I can more timely respond to communications routed to the MBTA. I have been advised by our IT department that we have the capacity to search for a specific domain (i.e. sender domain = mbta.com) but that we are unable to conduct a search for all domains except for mbta.com. In other words, your additional modification of the scope of your request. As you will recall as and more thoroughly discussed in my November 14, 2023 communication to you, our initial search yielded a result in excess of 169,000 emails. request for us to conduct a search of emails sent "to or from the MBTA after January 2021 from non-MBTA email addresses/domains" is not possible. In order to provide for a more affordable and efficient response, we ask that you please provide Please reply at your earliest convenience to clarify, or assist in the modification of the scope of, your request so that we may more efficiently or affordably accommodate you.
