To Whom It May Concern:

Pursuant to the Massachusetts Public Records Law, M.G.L. c.66, ยง10, I hereby request the following records:

All policies and procedures regarding the provision of sexual education and/or health in Massachusetts schools.

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 calendar days, as the statute requires.

Dear Ms. Lipton,

On August 14, 2015, the Massachusetts Department of Elementary and Secondary Education (ESE) received your public record request seeking, "All policies and procedures regarding the provision of sexual education and/or health in Massachusetts schools." Attached are the records and information possessed by ESE that responds to your request.

1. The MA Comprehensive Health Curriculum Framework<http://www.doe.mass.edu/frameworks/health/1999/> details the concepts and learning standards for health education. Also, appendix B<http://www.doe.mass.edu/frameworks/health/1999/appii.html> has a detailing of the laws and policy around health and health education.

2. The Parental Notification Law<https://malegislature.gov/Laws/GeneralLaws/PartI/TitleXII/Chapter71/Section32A> for parents to opt their child out of sexuality education.

3. Attached is a policy statement issued in 2000. It provides guidance and clarification regarding the Department's role in providing support and services related to sexuality.

I hope you find this helpful. The records you have requested are possessed by the ESE Office of Nutrition, Health and Safety. Please direct additional questions or record requests to: nutrition@doe.mass.edu<http://www.doe.mass.edu/contact/orgdetail.aspx?orgcode=SSCE_NUT09>.
