Pursuant to the Massachusetts Public Records Law, I hereby request the following records:

The following materials regarding the imposition, assessment, collection and balances of inmate fees and debt:

a) All current policies and procedures regarding medical and room & board costs or fees for which inmates are or may become liable. Please include all policies and procedures related to how fees are set, accrued, imposed, collected, and enforced (such as those related to per diem fees, ability to pay determinations, penalties for late or non-payment, authorization for civil or criminal action for payment enforcement, etc).

b) All reports, databases, spreadsheets, or equivalent materials regarding debts/restitution paid to or owed to this department or any facility/agency under its jurisdiction in FY2021. Please include all relevant data regarding medical and room & board costs, including the number of individuals charged for medical and room & board costs or fees and the total amount of medical and room & board fees imposed in FY2021.

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Hi Kate,

Thank you so much for this. In the "Inmate Fund" policy you shared, it says "The Director of Administrative Services or a designee shall have access to all institutions and their fiscal records for audit purposes to determine compliance with 103 CMR 405.00"--suggesting that fiscal records, including those concerning room & board or medical fee collection--do exist and are indeed collected centrally. Would you be able to double check to see if those can be found and shared per our original request?

And could you also confirm for us that, as a matter of policy, Massachusetts DOC does indeed impose and collect room & board fees for incarcerated individuals?
