To Whom It May Concern:

Pursuant to the Massachusetts Public Records Law, I hereby request the following records:

Any planning documents, produced works (written, visual or video), public mailers, correspondence, costs (including ad buys, etc.), and other public documents related to the public relations campaign mandated by Chapter 55 of Acts of 2017, § 52(ii), specifically:

"The Executive Office of Public Safety and Security shall establish public awareness campaigns to: ...(ii) inform the public that a gift of marijuana given in conjunction with the sale of another item in order to evade laws governing the sale of marijuana is illegal and that a person who grants such a gift is subject to prosecution."

I also specifically request any correspondence from EOPSS Secretary Daniel Bennett relating to "marijuana" "gifting". Please include any correspondence containing both those words or that are otherwise related to laws surrounding gifting programs in Massachusetts.

Please include any public documents found from July 1, 2017 to the date of the beginning of your search for the materials.

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

Sincerely,

Chris Caesar

Hello Mr. Melander,

May I have an updated ETA for these documents? Thank you kindly.

From: Executive Office of Public Safety and Security

Yes. I will have a substantive response for you on Thursday.

Thank you.

Hi Mr. Melander,

I know you are no doubt juggling many responsibilities, but I was curious if there was any update on the response you indicated we'd receive last week. Thanks for your replies and help.

From: Chris Caesar

Mr. Melander,

Please advise when the requested documents will be provided. We've long passed the due date requirements of the statute. The initial request was sent over 3 months ago.

Thank you.

From: Chris Caesar

Please advise when I will receive the information I requested: I assume since I was told I'd have a substantive request on Thursday the documents should be mostly compiled and ready for delivery. Thank you

Good Afternoon,

By way of introduction, my name is Arielle Mullaney and I am another attorney at EOPSS. I also handle the public records requests. John forwarded me your below email so I just wanted to be sure I provided an update.

We are working on your request. I have conducted a search with the Executive Office of Technology Services and Security for the portion of your request which seeks “correspondence from EOPSS Secretary Daniel Bennett relating to ‘marijuana’ ‘gifting.’” The search yielded about 30 results. I am in the process of reviewing the emails now and will provide them to you as soon as I am able to.

Thank you.
