Pursuant to the Massachusetts Public Records Law, I hereby request the following records:

records of no trespass issued in 2020 and 2021, reason for no trespass orders issued, Massachusetts Maritime policy for no trespass orders, policy for means of service for no trespass orders, emails memos received by Chief Chris Slattery that contain requests for no trespass orders to be issued, no trespass orders are an administrative procedure and not governed by CH 66.

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

1) I respectfully appeal MMA response regarding withholding information for James Callan and #5. MMA states there have been (3) three no trespass orders issued 2020 to 2021, one against James Callan, Jeffrey Hagopian and a student covered by FERPA.
2) MMA states have the right to legally withholding documents, in regard to the student described as : police report including a cover sheet, field interview report, narrative, incident report, narrative and supplemental narrative leading to the no trespass and the means by which the no trespass was issued.
3) The files provided for my request of Jeff Hagopian's no trespass order provides only a statement by Trustee Wilkinson ,who after a verbal disagreement with Hagopian stated he was placed in fear. I request the police report, narrative, field notes, cover sheet, incident report or any supplemental documentation on the complaint and investigation of Trustee Wilkinson's complaint regarding Jeffery Hagopian.
4) Trustee Wilkinson did not immediately report Jeff Hagopian allegedly put him in fear to MMA Police Chief Slattery. As a Trustee one would presume an inherent responsibility and ethical understanding to appear impartial and without favor to his status, reporting to the Campus Police Chief is the proper venue. Instead, Trustee Wilkinson reported this alleged crime to his immediate subordinate, Admiral Fran McDonald. Wilkinson did not request a no trespass order in his statement of complaint. I request any emails between Admiral McDonald and Trustee Wilkinson in regards to no trespassing Jeffrey Hagopian from Sept 9, 2021 to Sept 15, 2021.
5)I submit Kyle Donovan and her son Brett Donovan are the complainants which led to James Callan being no trespassed from MMA, ad infinitum. MMA claims any documentation surrounding Bretts and his mothers report are covered by FERPA. Brett Donovan and his mother Kyle Donovan emailed a letter of complaint July 1, 2021 emailed to Admiral McDonald, Brigid Pavolonis, Elizabeth Benway, Shannon Finning, P Lopez after he graduated and was not longer a student. See attached. Graduation commenced June 26, 2021, which makes Donovans complaint like any other citizen, a public record. By MMA own release of information, only 3 no trespass orders were issued from 2020 to 2021. I attached an email authored by Admiral Fran McDonald to James Callan addressing such a claim to further prove Brett Dononvan was not a Cadet covered by FERPA, merely a citizen. Please note in Admirals email to the accused, he considers two scenarios, first, he alleged Jim Callan sent pictures by accident with no malice, second Admiral alleged Jim Callan did not take into consideration how he hurt the Cadet when he is accused of sending pictures at graduation. Glaringly, Admiral McDonald does not consider Jim Callan was innocent until proven guilty. I therefore request the police report, incident report, investigative notes and report, any emails, note, text, memo investigation of the Donovan complaint which lead to the issuing of a no trespass order against James Callan to include any email to Police Chief Chris Slattery in regards to the no trespass order on Jim Callan. I respectfully request any email between Admiral McDonald, Chris Slattery, Shannon Finning, Kyle Donovan and Brett Donovan, P Lopez, Police Chief Chris Slattery, where James Callan is discussed and a no trespass order issued or promised to be issued against him, dates to include June 26, 2021 to August 24, 2021.

Thank you for taking the time to read my lengthy appeal. I request the fees waived for these requests as government transparency is of paramount importance to ensure diversity, inclusiveness, equity and fairness is established in any law enforcement action or when the government seeks to restrict the free movements and free speech of its citizens.. Massachusetts Maritime Academy has branded itself "The Commonwealths Leadership Academy" which they espouse respect for diverse educational thought and experiences to include racial and gender equity, inclusiveness and transparency. Free speech, freedom to pursue life, liberty and happiness, due process, these rights are guaranteed by the Constitution. We all should be afforded and guaranteed due process and professional review before any police action commences. These rights are not being protected or appreciated at Massachusetts Maritime Academy as evidenced when citizens and employees are falsely accused , punished and restricted of free movement, their characters defamed without proper police response, due process, documentation or investigation. This request will not be used for commercial use and I ask for fees to be waived as it is in the publics best interest to be aware of how public state institutions are organized, managed and how they use their power, influence and status unfairly and without regard to others reputation and employment.
