Pursuant to the Maryland Public Information Act, I hereby request the following records:

1. Written or electronic communications to and from the Maryland Department of Business and Economic Development from Dec. 1, 2017 through today (Dec. 20, 2019) relating or referring to the Opportunity Zones program created by the Tax Cuts and Jobs Act of 2017.

2. Written or electronic communications or other records from Dec. 1, 2017 through today (Dec. 20, 2019) relating or referring to potential investments in designated opportunity zones and or Qualified Opportunity Zones businesses in the state of Maryland.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 calendar days, as the statute requires.

Dear Mr. Banister,

We are in receipt of your request and I wanted to get back to you with a
few questions.

I have not had a chance to check with many of my colleagues who are out for
the holiday, but after some initial discussions, we are confident that your
request, as written, will produce hundreds if not more than 1,000
responsive documents that will have to be reviewed individually to
ensure we are not releasing anything protected by the PIA. The reason for
this is that when we do a search for documents related to Opportunity
Zones, that could pull up documents related to the Opportunity Zones
Leadership Task Force, of which our Secretary is a member. We also expect
to have a significant number of emails related to the Maryland Opportunity
Zones Enhancement Credit legislation, which our department worked on and
administers.

Please note that we would need to charge for time researching and reviewing
documents. For research and review, the first two hours are free, and a
conservative estimate for the additional review time fee would be about
$4,000, though this could certainly increase or decrease depending on how
many documents are produced. In addition, we would need to charge for
copying, which is 20 cents per page, as we would not be able to fulfill
this request electronically. Again, based on an estimate of 1,000 pages,
that would be $200.

I also need to advise that given the volume of documents, it is likely that
we will exceed the 30 days as set forth in the Act in order to provide you
with all responsive documents.

If you wish, you can narrow your request and that may change the
research/review time and copying fees. If you wish to discuss with me over
the phone, I am happy to do so. I am here today and tomorrow if you'd like
to call me at the number below.

Please let me know how you wish to proceed and again, happy to work with

Hi Karen,

I apologize for the delay on this. I was out of office during the last week of December and must have missed your email. I understand that my request was broad and I am willing to work with you to narrow it. We are looking to gain more insight into how states chose which areas to designate as Opportunity Zones after the law was first enacted, so you can narrow the time frame to Dec. 1, 2017 - April 25, 2018, because that is when Gov. Hogan announced the selections.

Since that is a 5-6 month time frame, it is significantly shorter than the 24 months I initially proposed and should hopefully help reduce the overall amount of documents that need to be searched through. If that is not narrow enough, I would be happy to hop on a phone call to talk about other ways we could make the search more feasible.

back to you. Just curious...did you also contact the Maryland Department of
Housing and Community Development? They have taken the lead on this
initiative so just wanted to see if you had reached out as they are also
likely to have responsive records.

Also, are you only looking for records related to the selection of the OZs?
If so, that will certainly help to narrow our search.
