Pursuant to the Iowa Open Records Law, I hereby request the following records:

An electronic list of all books prohibited from your school district's libraries, classrooms and other distribution systems since the passage of Senate File 496, a new state law that the Des Moines Register says "requires teachers and administrators to review their libraries and classrooms for books that depict sex acts."

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

We are in receipt of your Public Records request dated 10/5/2023. I apologize for the delay as Caitlin is no longer with our district. Please be advised that we are currently in the process of evaluating your request in an effort to provide you an estimated timeline and cost for any records we maintain that are responsive to your request.

Iowa law provides that, “A governmental body should provide records “promptly” and as soon as feasible unless the size or nature of the request makes that infeasible.” Time to locate a record(s) can vary considerably depending on: the specificity of the request, the number of potentially responsive documents, the age of the documents, the location of the documents, and whether the documents are stored electronically or not.

Additionally, Iowa Code Section 22.3(2) states that all reasonable expenses for the production of a public record request can be charged to the requestor. Reasonable expenses include actual costs associated with the retrieval, review and production of the records. In addition, the Iowa Code specifies that fulfillment of a public records request “may be contingent upon receipt of payment of expenses to be incurred in fulfilling the request and such estimated expenses shall be communicated to the requestor upon receipt of the request….” See Iowa Code Section 22.3(1).

Once your request is fully evaluated and should there be a charge to retrieve, review and/or copy the records, the District will provide you the estimated cost before working on the request and you will be given an option of modifying the type or scope of the request, in desired, to help reduce the fees and timeline for a response. In accordance with Iowa law, the District will not charge for requests that take less than 30 minutes to retrieve and produce.

This letter shall serve as notice that, in accordance with District policy and the authority granted in Iowa law, the District will require payment upfront and will begin to act upon your request once payment is received and will inform you of the estimated completion date. Payment is to be made to the Linn-Mar Community School District, Business Office, 2999 North 10th Street, Marion, IA 52302. If the actual cost of retrieving, reviewing, and releasing the requested records is less than the estimated amount, the District will refund any difference. And, if the cost is more, the District will let you know of any additional fees to be paid before releasing the requested records.
