To Whom It May Concern:

Pursuant to the Maine Freedom of Access Act ("FOAA"), I hereby request the following records:

I am requesting any and all documents that your agency retains regarding the 2016 Republican National Convention (RNC) held in Cleveland, Ohio. In particular, this request is for all records included but not limited to correspondence, memorandum of understandings (MOU), electronic data, e-mails, photographs, intelligence data, notes or other materials.

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by 1 M.R.S.A. § 408(6). The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Sincerely,

Melissa Hill

From: Parr, Christopher

Dear Ms. Hill:

This email further responds to your Freedom of Access Act (“FOAA”) request, which appears below.

At this time, please be advised of the following:

1. I estimate that once work is initiated on your FOAA request, our agency will be able to process the request within 30 to 40 business days.
2. Although I cannot yet provide an estimate of the total fee that will be charged to process your FOAA request, I anticipate that the fee will exceed $30. Accordingly, pursuant to 1 M.R.S. § 408-A(9), when convenient, would you please let me know whether you want us to proceed working on your request?
3. To the extent what records we have that are responsive to your request include or constitute information that, by law, is confidential or otherwise not public, we will be obligated to deny access to such records. We thus here reserve our duty to do so.

Respectfully, C

Dear Mr. Parr,

As a follow-up, yes you may proceed with working on this request with the fee estimate of over $30. If the fee estimate is likely to be over $100, please contact me again with an updated estimate.

Thank you,

Melissa Hill

From: Parr, Christopher

Dear Ms. Hill:

As an update:

Although I cannot yet provide an estimate of the total fee our agency will charge to process your FOAA request, given the amount of material that has been sent to me to review, I think the fee that our agency will charge just for the staff time that will need to be dedicated to processing the request will be between $100 and $150.

Again, that is just an estimate; the staff time fee could be more or less than that, and there likely will be additional fees associated with, e.g., copying costs.

We will continue to work on your request, as time permits.

Respectfully, C

From: Parr, Christopher

Dear Ms. Hill:

This email further responds to your FOAA request, as stated in the initial email you sent to our agency below.

Although I cannot yet provide a reasonable estimate of the total fee that will be charged by our agency to process your request, I do anticipate at this time that, given the volume of records we appear to have that are or might be responsive to your request, the total fee will exceed $100.

Given that information, would you like us to continue to process your FOAA request?

If there is any way we might be able to work with you to narrow the scope of your FOAA request so that you might obtain more specific Maine State Police records or types of records, please let me know, as we would be happy to do so.

Respectfully, C

From: Melissa Hill

Dear Mr. Parr,

If the total costs are likely between $100-150 as you estimated in previous correspondence, I would be fine with paying that but if you believe it would be a lot more - please let me know as I can try to narrow this request to keep the fees reasonable.

Thank you,

Melissa Hill

From: Parr, Christopher

Dear Ms. Hill:

Based on the amount of work we have performed so far on your FOAA request, and the amount of time I anticipate we will need to complete that work, I at this time estimate that the total fee to process the request will, at a minimum, be $150.

Accordingly:

1. Would you like us to continue to work on your FOAA request?

2. Would you like to revise/narrow the scope of the request in some way? For example, to particular types of records and/or to records of only the senior most officer(s) who attended the convention?

Dear Mr. Parr,

I would like to narrow my request to include only any copies of Emergency Management Assistance Compacts (EMAC), Memorandums of Understanding (MUO) and/or mutual aid agreements between the Maine State Police and City of Cleveland. I would also like copies of any RNC preparatory materials that were provided along with or after acceptance of these agreements.

Please let me know if you have any questions or need any additional clarification on this narrowed request.

Thank you,

Melissa Hill

Dear Ms. Hill:

This email further responds to your pending FOAA request.

At your convenience, would you please clarify what you mean by the following?:

§ “RNC preparatory materials”

Further, I understand you to be requesting such “materials” as they relate to “Emergency Management Assistance Compacts (EMAC), Memorandums of Understanding (MUO) and/or mutual aid agreements between the Maine State Police and City of Cleveland”; if my understanding as just stated is incorrect, please let me know.

Dear Mr. Parr,

Upon further consideration, I am no longer asking for the "RNC preparatory materials”. Please focus only on materials relating to the “Emergency Management Assistance Compacts (EMAC), Memorandums of Understanding (MUO) and/or mutual aid agreements between the Maine State Police and City of Cleveland”.

Thank you,

Melissa Hill
