To Whom It May Concern:

Pursuant to the Maine Freedom of Access Act, I hereby request the following records:

1) Copies of all invoices submitted to the department by ID.me for identity verification services from the date the department's identity verification contract with ID.me began until the present. These invoices include the number of successful identity verifications completed by ID.me during the designated invoice period. However, If the Department separately maintains data on successful ID.me verifications during the duration of the contract I will accept the data in lieu of the invoices.

2) Aggregate monthly data, from Jan. 1, 2019 until the date this request is processed, documenting the number of unemployment insurance applications received, approved, and denied. Please note, I am not asking for any personally identifiable information.

3) All department contracts, memorandums of understanding, statements of work, and contract performance evaluations regarding ID.me.

I ask that all fees be waived as intend to use the requested records to further public understanding of public agencies and not for any commercial purpose. In the event you choose to impose fees, I request a detailed breakdown of the fees, including the hourly wage of each employee involved and an explanation justifying the employee hours required to fulfill the request.

Should you choose to reject this request or redact portions of responsive documents, I ask that you provide a detailed breakdown of the statutory exemptions and associated case law underlying your decision to withhold each/any portions from public review.

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by 1 M.R.S.A. § 408(6). The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

This letter is in response to your 09 March 2022 request (fax) for an update to your request for records received by the Maine Department of Labor (“Department”). The original FOAA request dated 03 February 2022 and received via fax on Friday, 11 February 2022, was initially responded to on 15 February 2022, pursuant to the Freedom of Access Act (FOAA), 1 M.R.S. §§ 400 – 410.

To the extent the Department has public records responsive and releasable for your request, the Department will produce them within a reasonable time. Please note, a state agency is not required to set aside its regular activities to respond to a FOAA request, nor is an agency required to create records that do not exist (1 M.R.S. §408-A sub-§5 and sub-§6). Also, many of the documents requested, if they exist, may be confidential. Records that are subject to a privilege, designated as confidential by statute, or otherwise exempt from the definition of “public records” are not subject to disclosure under FOAA. The Department requires a reasonable period to ascertain, as an initial matter, whether any requested documents exist, and to ascertain which of the records, or parts thereof, relate to your request, identify which records are subject to public access, and determine which records, or portions thereof, are confidential, otherwise protected from disclosure, or otherwise outside the scope of FOAA. A Department data collection meeting occurred 08 March 2022. It may take the Department several weeks or longer, to complete an initial review sufficient to provide an initial estimate of responding to this FOAA request. Depending on the volume of the requested documents, review and redaction may take considerably more time, and that may change any initial estimate.

Under FOAA, the Department is permitted to charge a fee to “cover the actual cost of searching for, retrieving and compiling the requested public record of not more than $25 per hour after the first two hours of staff time per request” 1 M.R.S. § 408-A(8).
