Pursuant to the Maine Freedom of Access Act, I hereby request the following records:

• The current procedure for procuring personal protective equipment (PPE) on behalf of agencies and entities within the jurisdiction of this office. If this office manages PPE requests for county, local, or private entities, please also provide any guiding material for soliciting, receiving, organizing, and fulfilling those requests.

• Any bids placed by this agency for the acquisition of PPE for this office or on behalf of any entity within the jurisdiction of this agency.

• Any available spreadsheet or aggregate information related to bids for PPE. Please provide all available segregable data, including but not limited to the source, the quantity, and the success of the bid.

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by 1 M.R.S.A. § 408(6). The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Ms. Lipton,
I am the Deputy Commissioner for the Department of Defense, Veterans and Emergency Management and the point of contact for FOAA requests in our department. I received your request on June 17, 2020 for access to certain State records under the Maine Freedom of Access Act, 1 MRSA section 400; in particular records pertaining to Maine Emergency Management Agency Personal Protective Equipment purchase procedures and related data. The records you have requested are extensive and as I am sure you are aware, both our President and the Governor of the State of Maine have declared States of Emergency. As a result, MEMA has gone into full Emergency Operations status. The folks that would be researching and answering your request are likely working 7 days a week as well as extended hours responding to the crisis across the State of Maine. Pulling them from their duties could prevent, hinder or delay necessary action we must take to protect Maine citizens during the COVID-19 State of Emergency. At this time I don't have an estimate on when we will be able to respond to your request. My plan is to respond following the closure of the incident period. The incident period for COVID-19 began on January 20, 2020 and will remain open throughout the duration of the Public Health Emergency, as determined by the Secretary of the U.S. Department of Health and Human Services.
When an end to the incident period is declared, I will re-engage with MEMA and provide you with responsive records. Thank you for your patience.
