Pursuant to the Wisconsin Open Records Act, I hereby request the following records:

Information on officer involved shootings (including fatal police shootings of civilians, non-fatal police shootings of civilians and police shootings at a civilian that missed) for 2013 and 2020, including incident-level information specifying the date of each incident, race and gender of all subjects involved, what weapon if any they were armed with, any injuries or deaths resulting from the incident, the names of all officers involved, whether administrative investigations found the incidents to be justified under police department policy and any disciplinary actions taken against the officers as a result of the incident. If all aspects of this request are not available, please provide all relevant information responsive to this request.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

If you are requesting a crash report, these are maintained at the Department of Transportation. They can be contacted directly at https://app.wi.gov/crashreports or by calling (608) 266-8753 (and selecting option 3). For processing this request, you will need the DOT document number located in the upper right corner of the Driver Exchange of Information Form. This document number will begin with 9B or 01L. Crash reports are available from DOT approximately 2 weeks after the date of the crash.

Madison Police Department does not keep records of OICI in a central location in any fashion. Cases are tracked by case number, involved individuals, and by IBR type; which does not have OICI as a type. I am sure a listing of IBR case types is available on our website as well as several others. You would need to provide me names or case numbers to have a return on this request. Additionally, post 2015 all OICI incidents in Wisconsin were investigated by the Wisconsin Department of Justice Division of Criminal Investigations, where the records you are requesting live and are maintained. If you have victims, officer names, or case numbers from the 2013-2014 time period, please initiate a new request. This request is closed with no responsive records. I have no list of OICI investigations, victims etc. That is not how our records are kept. I suggest a simple google search for City of Madison during that time period and a resubmission of a new request. For OICI investigation records 2015-present visit the Wisconsin Department of Justice website.

After a thorough search, I have determined no record exists in the Madison Police Department related to your request."[T]he public records law does not require an authority to provide requested information if no record exists, or to simply answer questions about a topic of interest to the requester.
