Pursuant to the Wisconsin Open Records Act, I hereby request the following records:

Materials related to this agency's acquisition of, access to, preservation of, or disclosure of automated license plate readers (ALPR) or ALPR data:

1. Policies related to the adoption of ALPR technology, including those guiding the procurement process or necessary administrative obligations before acquisition.

2. Training policies, requirements, and materials for automatic license plate reader system operators.

3. Databases used to compare data obtained by the automatic license plate reader system.

4. Policies related to the retention and security of captured ALPR data, including those regarding:
- the length of time after capture that data may be preserved
- exceptions to general data preservation policies
- internal data security and access
- data destruction

5. Policies related to the sharing of captured ALPR data by this agency with other agencies, including those directing:
- the manner in which another agency may request data
- the circumstances under which captured data may be shared, and
- the responsibilities of the recipient agency in regards to data retention and use.

Crash reports are available from DOT approximately 2 weeks after the date of the crash.

This email is reply to your August 11th public records request for Madison Police Department records associated with Automated License Plate Readers. Madison Police Department does not own any equipment or use any equipment that is an ALPR. Like most agencies we do have a parking enforcement vehicle that can photograph a license plate via photo as it passes, but only in relation to parking violations and only for that purpose. I am also sure that our squad cameras and street cameras do at some point capture a license plate of a vehicle. However, I would not consider this automated license plate reader technology. There are no responsive records to your request. This request is closed.

Legal:
After a thorough search, I have determined no record exists in the Madison Police Department related to your request."[T]he public records law does not require an authority to provide requested information if no record exists, or to simply answer questions about a topic of interest to the requester. "Journal Times, 2015 WI 56, ¶ 55 (citation omitted); see also State ex rel. Zinngrabe v. Sch. Dist. of Sevastopol, 146 Wis. 2d 629, 431 N.W.2d 734 (Ct. App. 1988). However, if no responsive record exists, the records custodian should inform the requester. Cf. State ex rel. Zinngrabe, 146 Wis. 2d 629.
