To Whom It May Concern:

Pursuant to the California Public Records Act (California Government Code ยงยง 6250), I hereby request the following records:

Any database or other records of hate crimes or crimes evidencing bias of race, color, ancestry, ethnicity, religion, gender, gender identity, sexual orientation, national origin or disability reported to or investigated by your agency since Jan. 1, 2010, containing at least the following fields:

the incident number
date of the incident
whether the crime was against individuals or a business / property
number of victims
race or ethnicity of the victims
gender of the victims
the offense classification
the location of the incident
the bias motivation (anti-black, anti-muslim, etc)

I would like the records in a machine-readable, electronic format if possible. If the records are kept in another format, or kept individually, I would still like copies.

This request is made as part of the Documenting Hate Project, a collaboration involving dozens of news organizations, led by ProPublica. Coverage from the project is compiled at https://projects.propublica.org/graphics/hatecrimes#hatecrime-coverage.

This request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 calendar days, as the statute requires.

Sincerely,

Ken Schwencke

Mr. Schwencke,

I am writing to acknowledge receipt of your request for information. I will coordinate with the appropriate department(s) to determine availability of records. We will contact you if further clarification is necessary. Pursuant to California Government Code Section 6253(c), we will require an additional 14 days to fully research our records to determine which records, if any, are responsive to your request and/or whether the requested records are disclosable records. We will get back to you no later than 8/28/17.

Fees must be paid in advance. You will be provided with an estimated cost once a determination of available and disclosable records is made. Copies are .10 per page single sided or .15 per page double sided for standard size documents plus postage if mailed. Additional fees will apply for oversized documents. If documents are available electronically, depending on files size, we may be able to email to you.

Thank you.

Hi Sonia,

Thanks so much for your help! I really appreciate it. I have two questions: 1) are "anti-reproduction rights" crimes considered hate crimes? and 2) According to FBI records, there was another 2010 incident that occurred on 2010-09-11. Was that later found to not have been a hate crime?

Thanks again,
Ken Schwencke
