This is a public records request made via MuckRock under the Louisiana Public Records Law, seeking records related to law enforcement officer certification in this state.

This request is brought by Big Local News along with a collaboration of news organizations, including ABC News, KQED, MuckRock, the Howard Center for Investigative Journalism and other news organizations. Big Local News is a program of Stanford University’s Journalism and Democracy Initiative and helps journalists collect, process and analyze public data.

We are seeking two categories of certification records:

* All certified officers
All law enforcement officers who are actively certified as of the date of this request (or when the request is processed). If your system maintains historical records of previously certified officers who are no longer active, please include them as far back as possible. If correctional officers are certified by your agency, please include them as well.

* Decertified officers
All law enforcement officers who have been decertified through revocations, voluntary surrenders, suspensions or any other actions going back as far as possible. Please include records for decertified correctional officers if available.

Data elements for certified officers:
* Officer unique ID number
* POST or state certification ID number
* Officer’s full name
* Officer’s date of birth or, if not releasable, year of birth or current age
* Officer’s city and/or zip code of residence
* Officer’s last/current department or agency
* Officer’s last/current department or agency start date
* Officer’s last/current position and/or rank at that department or agency
* Officer’s previous departments/agencies (employment history), with start and end dates
* Officer’s positions and/or ranks at previous departments or agencies
* Officer’s original date of certification
* Current status of certification (active, lapsed, expired, suspended, etc.)
* Last action taken on certification
* Date of last action on certification
* Disciplinary actions taken against this officer’s certification
* Dates of disciplinary actions taken against this officer’s certification
* Training history/additional certifications of this officer, if available

Data elements for decertified officers:
* Officer unique ID number
* POST ID number
* Officer’s full name
* Officer’s date of birth or, if not releasable, year of birth or current age
* Officer’s city and/or zip code of residence.
* Officer’s last department/agency, with start and end date
* Officer’s last position and/or rank at that department or agency
* Decertification action taken (revocation, suspension, voluntary surrender, etc.)
* Date decertification action taken
* POST case number, if applicable
* Reason for decertification or similar action

If your certification system contains data elements not listed above, please include them in the response, provided they are releasable under the law. On the other hand, we recognize some of the information we are asking for may not be tracked by your system. If that is the case, we are willing to accept as many of the data elements as your agency maintains. If some records are more readily available, we are happy to receive partial information as soon as possible while the remaining request is processed.

In addition to the data elements listed, we request documentation necessary to understand and interpret the data, including but not limited to record layouts, data dictionaries, code sheets, lookup tables, etc.

Our preference is to receive structured data provided in a machine-readable text file, such as delimited or fixed-width formats. We can also handle a variety of other data formats including SQL databases, Excel workbooks and MS Access. If there are additional formats your agency would prefer to provide, please let us know.

We are seeking this information as a news media organization on a matter of public interest concerning the conduct of government. As such, we ask for a waiver of all fees, if allowed under state law. If fees are necessary to reimburse the agency for actual costs, we agree to pay up to $100. If costs exceed that amount, please let us know before fulfilling the request.

Hi Stephanie:

In response to your inquiry, I have attached a compilation of all officers whose certification has been revoked. That list is current through last May, and has not been validated.
In response to your request for information on all peace officers, much of that information is available on the officer’s history report. Those records can only be accessed individually, and there are more than 65,000 as of this morning. It takes approximately 2 minutes to access each one to prepare an electronic copy. At 2 minutes/record, X 65,000 @ $ 10.00/labor approximates a cost of more than $ 21,000 to compile and respond to your request. Our office policy is not to waive fees of this magnitude and we won’t in this case.

The information you seek does not exist in any document form, although but most of the data resides in the POST data system. Since there are no structured queries(reports) to access that data in the system as you requested, we would have to hire a specialist to compile and configure your data request. We have no funds budgeted for this purpose.

As for the format, coding, and data dictionary regarding the POST data systems, that information regarding is exempt from the Louisiana public records law:

§3.2. Proprietary and trade secret information

B. Nothing in this Chapter shall be construed to require the disclosure of proprietary or trade secret information pertaining to any code, pattern, formula, design, device, method, or process which has been submitted to a public body in order to facilitate the further research, development, or commercialization of such code, pattern, formula, design, device, method, or process.

In addition, Louisiana R.S. 15.1212.1 makes clear that information stored in the POST database other than training and certification records shall not be disclosed:

F. The information received by the commission as provided in R.S. 15:1212(B)(4), other than certification and training records of a law enforcement officer, shall be used for hiring or revocation purposes only and shall not be disclosed to any persons other than a qualifying law enforcement agency.

You are not a qualifying law enforcement agency.

I'm talking with my editors about the possibility of paying for records of currently certified officers. In order to get permission to do this, though, we need to know a little bit more about the process of accessing the records and possibly hiring a specialist to access the data from the POST system.

In response to your latest inquiry regarding the original record request, I refer you back to a previous email from October 10th, in which you mentioned you would send a note regarding a SQL query on the POST database.

I haven’t received an update from you since that date (October 10, 2022) regarding a SQL query.

I will note that I don’t have the ability to run a SQL query on the POST database nor the technical expertise for it. Information in that database that is used for hiring or revocation purposes cannot be disclosed to anyone outside of a qualifying law enforcement agency.

LA Revised Statutes: R.S. 15:1212.1. Report to the system; duties of persons and agencies

A. All law enforcement agencies, correctional agencies, and institutions shall provide the required data as provided for in R.S. 15:1212(B)(4) in accordance with the rules adopted by the Louisiana Commission on Law Enforcement and the Administration of Criminal Justice.
B. All law enforcement agencies shall provide any other such assistance, information, and data which are reasonable and available to enable the commission to properly carry out its powers and duties.
C. A law enforcement agency shall obtain and certify to the commission that it has received the required information as provided in R.S. 15:1212(B)(4) from the database before hiring a law enforcement officer.
D. Except in cases of willful or wanton misconduct or gross negligence, the commission, Council on Peace Officer Standards and Training, or a law enforcement agency, correctional agency, or institution shall not be civilly or criminally liable for the release or reporting of information provided in R.S. 15:1212(B)(4) when released or reported pursuant to the provisions of this Section.
E. The personal information of a peace officer including the peace officer's home address, home telephone number, birth date, Social Security number, driver's license number, and username for P.O.S.T. electronic data/training systems contained in the database central depository shall be confidential and shall not be subject to disclosure by the commission or Council on Peace Officer Standards and Training pursuant to the Public Records Law but may be disclosed to a requesting law enforcement agency in this or another state, accredited training academies of the Council on Peace Officer Standards and Training, and to councils on peace officer standards and training in other states.
F. The information received by the commission as provided in R.S. 15:1212(B)(4), other than certification and training records of a law enforcement officer, shall be used for hiring or revocation purposes only and shall not be disclosed to any persons other than a qualifying law enforcement agency.
