Pursuant to the California Public Records Act, I hereby request the following records:

All records, documents, emails, and other correspondence regarding or related to the 2008 model AS 350 B2 Eurocopter helicopter as well as any additional equipment attached to the aircraft. This aircraft has serial number 4491 and holds registration N913WB. This aircraft uses the mode-s code of 53121706 in octal or ACA3C6 in hexadecimal. I request records, documents, emails, privacy assessments, purchase orders, and other correspondence relating to the equipment.

Additionally, I would like any manuals, procedures, communications protocols, and any communications related to inter-agency coordination. This should include pilot logs, flight plans, and surveillance plans. Specifically, I am looking for any and all data relating to flights for the city of Los Angeles over the last week with a focus on June 2nd, and June 3rd where the aircraft was documented flying in circles over the demonstrations at an altitude of 925 feet. Any imaging or other surveillance data from onboard collection is additionally requested, as well as any policies which govern the collection, processing, use, and dissemination of this data. Any communication about this data or related data should be included, especially inter-agency communications, and metadata.

This information is part of a journalistic research project involving the Seattle Privacy Coalition.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

We reviewed your request dated June 4, 2020.

 

 

Your request was made under the California Public Records Act (the Act). The Department is cognizant of its responsibilities under the Act. It recognizes the statutory scheme was enacted to maximize citizen access to the workings of government. The Act does not mandate disclosure of all documents within the government’s possession. Rather, by specific exemption and reference to other statutes, the Act recognizes that there are boundaries where the public’s right to access must be balanced against such weighty considerations as the right of privacy, a right of constitutional dimension under California Constitution, Article 1, Section 1. The law also exempts from disclosure records that are privileged or confidential or otherwise exempt under either express provisions of the Act or pursuant to applicable federal or state law, per California Government Code Sections 6254(b); 6254(c); 6254(f); 6254(k); and 6255.

 

Please be advised that your request was not “a request for a copy of records that reasonably describes an identifiable record or records” as required by Government Code Section 6253(b). However, in an effort to comply with the spirit of the CPRA, the Department conducted a search for records pertaining to your requests and responds to them as follows:

 

With regards to your request for “All records, documents, emails, and other correspondence regarding or related to the 2008 model AS-350 B2 Euro Copter helicopter as well as additional equipment attached to the aircraft”, Per Air Support Division Sergeant Gonzalez, J. #24261, no additional equipment has been attached to aircraft N913WB Serial Number 4491.

 

To the extent your request is understood to seek records related to investigations, in accordance with the California Government Code, Section 6254(f), records of investigations conducted by, or investigatory files compiled by, any local police agency for law enforcement purposes are exempt from disclosure. To the extent that records were located, they are either investigatory records themselves or properly part of an investigative file. Therefore, we are denying your request. The records may be provided pursuant to a subpoena or court order related to pending litigation.

 

To the extent your request is understood to seek Aircraft maintenance records, please contact the Department of General Services at (213) 928-9555 or visit their website at http://gsd.lacity.org for the records that you are seeking.

 

With regards to your request for records, documents, emails, privacy assessments, purchase orders, and other correspondence relating to the equipment of aircraft Serial Number 4491, please be advised that the Purchase Order number used to purchase the aircraft was 000849368 from 2008, however a copy of the purchase order is no longer available as the record retention policy of the City of Los Angeles provides the authority to purge or destroy records according to the appropriate disposition schedule which can be found at the following website:

With regards to your request for manuals, procedures, communications protocol, and any communications related to inter-agency coordination.  Pilot logs, flight plans, surveillance plans.  Imaging or other surveillance data from onboard collection, processing, use, and dissemination of the data, especially inter-agency communications and metadata, please be advised that Air Support Division does not maintain, manuals, procedures, communication protocol or any communications for inter-agency coordination.  No flight plans were completed as the flights inquired about per your request were VFR patrol flights and flight plans are not required.  There are no surveillance plans available as these flights were in support of general patrol operations.  There is no imaging or surveillance data available, the aircraft is not equipped with the ability to collect or retain such data.

 

Responsive documents have been provided to you regarding Aircrew Logs for Aircraft serial number 4491 for the dates requested.
