Pursuant to the California Public Records Act I am requesting the following records:

-Any data retention policies the related to the city’s Shared Mobility Device Program and the data received as part of that program.

According to the information made public by the city on legistar, Bird, Lime, Razor, Skip, Spin, and any subsequently approved companies are required to provide regular reports detailing the “number of deployed units, usage, trip destinations (heatmaps), maintenance, and compliance with program rules.”

This request is being filed in light of this ACLU of Southern California recent brief regarding LA’s scooter trip data retention. (https://www.eff.org/press/releases/eff-aclu-urge-appeals-court-revive-challenge-los-angeles-collection-scooter-riders)

Are you sure? The City's contracts with the scooter companies state that the companies are required to provide the City with the exact data I requested. Have the scooter companies not been honoring that part of the contract or has the city chosen not to save the data? I find it very hard to believe the city has never received a single report from any scooter company operating in the city—not even one showing how many scooters exist in the city. Are you saying the City has never once received a report showing whether the scooter companies are in compliance with state law despite the companies being required to provide such data under the terms of the contract?

I'm looking into this further. It seems that the City doesn't necessarily keep the data on file, but instead simply has access to the info/data. I'll get your a more definitive answer ASAP.
