Pursuant to the Oklahoma Open Records Act, I hereby request the following records:

1. the total number of use of force incidents reported by law enforcement, separated by year and by type of force used from 2013-2020 (for example: 27 taser incidents in 2019, 16 taser incidents in 2020, 3 baton incidents in 2019, 4 baton incidents in 2020, etc.)
2. the total number of civilian complaints alleging any form of law enforcement misconduct that were reported and the total number sustained from 2013-2020, separated by year (for example: 8 complaints in 2016, 2 complaints sustained in 2016, 4 complaints in 2017, 1 complaint sustained in 2017, etc.)
3. the total number of civilian complaints alleging law enforcement use of excessive force that were reported and the total number sustained from 2013-2020, separated by year.
4. the total number of civilian complaints alleging biased policing or racial profiling that were reported and the total number sustained from 2013-2020, separated by year.
5. the total number of civilian complaints alleging criminal conduct that were reported and the total number sustained from 2013-2020, separated by year.
6. all information reported to the FBI’s National Use-of-Force Data Collection program to date.
7. a list of all officer involved shootings that were directed at a person from 2013-2020 (excluding shootings of animals and accidental discharges that are not directed at a person).

If only partial information is available responsive to one or more of these requests, please provide all of the information that is available.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

The request below has been sent to Mrs. Nunley (Lawton Police Department Statistician) and she was forwarded it also to Mr. Toquinto (Lawton Police Department, Criminal Analyst).

Records division does not handle statistics. We process criminal open records request in reference to files, documents, photos, audio, video, etc. but do not do stats.

The City of Lawton Police Department has reviewed its files and has determined there are no responsive record(s) to your request. The Oklahoma Open Records Act, 51 O.S. §24A.18, states, in pertinent part, that the Oklahoma Open Records Act ‘does not impose any additional recordkeeping requirements on public bodies or public officials.’ This includes the creation of new reports that do not already exist, and the Lawton Police Department does not already possess these statistics.

Additionally, under the Act (specifically 51 O.S. §24A.5), the city is required to make available for inspection, copying, and/or mechanical reproduction during regular business hours any non-exempt record in its possession. The city is not required to mail or email records. Also, for any request that would cause excessive disruption of the essential functions of the public body, the city may charge a reasonable fee to recover the direct cost of record search and copying.

Accordingly, you or any other individual are welcome to stop by the city to inspect and/or pick up copies of any non-exempt records during regular business hours, i.e. Monday-Friday from 8:00 a.m. to 5:00 p.m. – excluding 12:00 p.m. to 1:00 p.m. Upon retrieval of the non-exempt records, you may be able to utilize said records to compile your desired statistics. Also, any such person should anticipate paying a reasonable fee to recover the direct cost of any such record search and copying.
