Hello Sir,
I understand that you think a citation should have been issued; however, the Lake Mary Police Department leaves citations to officer discretion. The officers are not obligated to write a citation in a crash just as they are not obligated to always write a citation when they stop someone for speeding or any other traffic violation. Ultimately, it is the crash report which shows fault in a crash. I am sorry I can't be of any more help in this matter.

Please forward to the State's Attorney for possible criminal charges. This crash resulted in grievous bodily injury. The nature of the driving of the offender certainly meets criteria for charging.

Hello Sir,
We don't have the MRI, and even if we did, it was not a record generated by our agency so we would not be able to release it. We only forward pertinent records that are requested by the State Attorney Office. You may, as a private citizen, can send whatever you like to the State Attorney Office if you are seeking criminal charges against the other driver. I would recommend speaking with one of the Assistant State Attorneys first, and then if they think you have something, they can create a case, take whatever you have, and they will ask us for whatever we have that is pertinent. Hopefully this helps.
