Pursuant to RCW Ch. 42.56 (Public Records Act), I hereby request the following records:

A copy of any work orders for the installation of the surveillance camera and/or traffic sensor installed at the Juanita Beach Park intersection on 6/17/2016.

I also request any purchase orders, contracts, and other documentation of purchase or lease of the electronic equipment installed with that sensor, or any software used to manage, collect, store, or analyze data pulled from that sensor.

I also request any documentation on how the device will be used, including any proposals detailing its installation, data collection, storage, or analysis, as well as any operational documentation, including guides and usage manuals created by the vendor or internally by the agency, any Privacy Threshold Analysis results for this camera system and its respective networks, any record of mandate, cited law code, and administrative requestors purposed for a camera installed at this location.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

PS As a side note, in the header of your initial communication, you noted a mailing address for the City using a utility billing payment address. Names and identities of those who have performed work for the city as it pertains to these cameras should be made plain. Who they are any how they came to be involved is very important because the City of Kirkland did and does fail to inform the public of cameras being erected in their neighborhoods without minding community impacts or to negotiate the information being collected at our expense.

Access to this information is important. While it is convenient for the City to post what they will on their own portal with a password gate, I would like copies of these documents as they become available be sent to the MuckRock address given your office. These are public records and should be made plain to the public.

To the extent that it appears you are requesting a list of names and identities of those who have performed work for the City as it pertains to these cameras, as previously noted, the City does not have a record that list the names of the employees as it pertains to the specific installation of cameras that is the subject of this request.  However, names of employees involved in the project are included in the records provided to you thus far and have not been exempted or redacted.
Please let us know what records you are intending to follow up on for appeal.  We are still actively working on your request and it is our goal to ensure that we provide the fullest assistance and produce the records you have requested.
In response to your message regarding the access availability regarding the records provided thus far, the access to the records provided via the City’s Records Portal is not restricted with a password gate for this request.  Members of the public may also access the files produced in response to this request without logging in to the City’s Records Portal.

In regard to your request that hardcopies of the records be mailed to MuckRock, we are happy to do so.  However, the City does charge for copy costs in excess of $5.00.  A rough estimate for the copy costs for the records produced thus far is 104 pages x $0.17/page for a total of $17.68.  Please note that this is a preliminary estimate as any attachments to the emails produced thus far has not been calculated.  As there will be a cost associated to production of the records via hardcopy, please clarify if you require a hard copy.
Lastly, we are continuing to work on review of the remaining records in response to your request and have identified records that contain the identification of specific system vulnerabilities in regard to the City’s traffic information system, specifically the operation manual you have requested for the traffic cameras.  In accordance with RCW 42.56.420(4), the City believes that a portion of the requested operation manual is exempt from public inspection.  If you are aware of some alternate citation in the RCW or case law which you believe could reliably be held as argument for release, please do provide it to the City for consideration.
At this time, the City of Kirkland requires additional time to review remaining assembled records to determine whether any of the information is exempt from production.  We believe that either another installment, or the remaining records responsive to your request, will be available on or before 9/28/16.  We will provide you with a status report on or before that date.
