To Whom It May Concern:

Pursuant to RCW Ch. 42.56 (Public Records Act), I hereby request the following records:

A copy of any work orders for the installation of the surveillance camera and/or traffic sensor installed at the Juanita Beach Park intersection on 6/17/2016.

I also request any purchase orders, contracts, and other documentation of purchase or lease of the electronic equipment installed with that sensor, or any software used to manage, collect, store, or analyze data pulled from that sensor.

I also request any documentation on how the device will be used, including any proposals detailing its installation, data collection, storage, or analysis, as well as any operational documentation, including guides and usage manuals created by the vendor or internally by the agency, any Privacy Threshold Analysis results for this camera system and its respective networks, any record of mandate, cited law code, and administrative requestors purposed for a camera installed at this location.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

From: Public Records

Good Morning Ms. Or Mr. Dean,
The City of Kirkland received your original email request last Thursday, June 30th. As yesterday, July 4th, was a holiday, today is the third business day since receipt of your request. On the day your request was received it was entered into our public records portal, an account was created for you, and you should have received an acknowledgment email through your portal account. Public Records did begin the process of identifying and locating potentially responsive records at that time. You can monitor actions taken by logging into your account.
You can also view the request from the external portal access here:
http://www.kirklandwa.gov/depart/Finance_and_Administration/Public_Records/Public_Records_Request/PRRPortal/cat4log.htm
There are parts of your request that will likely require clarification and, on initial review, it is likely the City will be responding in installments and that it will take longer than the initial five day response timeframe to produce some or all of the responsive records. You will receive a more formal response this week through your portal account. Please let us know if you did not receive the initial response email with the account link last week and it will be re-sent. Also, feel free to give us a call with any questions at 425 587 3190 - we are always happy to discuss your request, sometimes a conversation can be more readily informative than email exchanges!
Thank you,
Kirkland Public Records
More information can be found here:
http://www.kirklandwa.gov/depart/Finance_and_Administration/Public_Records/Public_Records_Request.htm
PS As a side note, in the header of your initial communication, you noted a mailing address for the City using a utility billing payment address. I am not sure if the payment processing vendor would understand or identify a public records request mailed to that Seattle address and forward it to the City as it is strictly for financial transactions. The actual physical and mailing address for the City (and for public records requests) is:
City of Kirkland

Kirkland, WA 98033

From: S. Dean

ATTN: City Clerk c/o K. Anderson

Dear Ms. Anderson,

Your file delay is duly noted.

I'd like to help with a few clerical amendments to help clean up the information for this request.

The utility billing address was included as a precaution because the City's FOIA address was unconfirmed to us at that time. Please remove the utility address if it does not further the purposes of your work to find records for this request.

Please do not use this reply queue to post password or account information because this information is posted on a public thread and then may be subject to unwanted tampering. Please send a separate and direct request to administrate log-in information vial e-mail to: requests@muckrock.com from your regular desk mail so the admin links are not published here online.

We look forward to any updates and information to fulfill this records request process.

Thank you for your due diligence with these matters.

Sincerely,

S. Dean (She, not he.)

Pursuant to the clarification received, we understand and interpret the request as follows:

1. Work orders for the installation of the cameras
2. Purchase orders, contracts, and documents for purchase/lease of the cameras
3. Purchase orders, contract, and documents for purchase/lease of the software used with the cameras
4. Proposals for installation of the cameras
5. Documents detailing the cameras data collection and storage and Operational guides/usage manuals for the cameras either created by the vendor or internally by the City of Kirkland

8. Administrative requestors, contractors, subcontractors, city agencies, city officials, city employees and related officers of the State or United States or any person involved in administrative government work, who could put conditions on or implement the camera as public work
9. Emails related to the planning, purchasing and work orders for the cameras.  As search terms were not provided for an email capture, we have discussed your request with staff who identified the following search terms:
Iteris
VantageNext
The City will conduct an email search for these terms from 1/01/16 to 6/30/16.  We will understand this to be a reasonable search unless we hear from you in the contrary.
According to the clarification received, the City provides the following update:
1.  Work order for the installation of the cameras
No responsive records were identified in response to this portion of your request.  Please note that the provisions of the Public Records Act, Ch. 42.56 RCW, pertain only to existing records and do not require the City to respond to requests for information or to create records in response to written inquiries.
Staff advises that the installation of the cameras at this intersection was a routine replacement of outdated equipment.
2.   Purchase orders, contracts, and documents for purchase/lease of the cameras
Records identified to this portion of your request have been uploaded to the City’s Records Portal.
Click Here.  Select the link to "View My Public Records Requests" and you will then be directed to log in to your portal account.  From your portal account, you may review and download the identified records. (http://www.kirklandwa.gov/depart/Finance_and_Administration/Public_Records/Public_Records_Request/PRRPortal.htm)
3.  Purchase orders, contract, and documents for purchase/lease of the software used with the cameras
Records identified to this portion of your request have been uploaded to the City’s Records Portal.
Click Here.  Select the link to "View My Public Records Requests" and you will then be directed to log in to your portal account.  From your portal account, you may review and download the identified records. (http://www.kirklandwa.gov/depart/Finance_and_Administration/Public_Records/Public_Records_Request/PRRPortal.htm)
4.    Proposals for installation of the cameras
No responsive records identified in response to this portion of your request.
5.  Documents detailing the cameras data collection and storage and Operational guides/usage manuals for the cameras either created by the vendor or internally by the City of Kirkland
The City requires additional time to review the identified records in response to this portion of your request to determine whether any of the information is exempt from production.
6.  Privacy Threshold Analysis results for this camera system

No responsive records identified in response to this portion of your request.
7.  A copy of any mandate or code cited for the cameras
As the City previously advised in its message dated 7/08/16, the Kirkland Municipal Code is available in a searchable format online at the following link:
Kirkland Municipal Code (http://www.codepublishing.com/WA/Kirkland/)
8.  Administrative requestors, contractors, subcontractors, city agencies, city officials, city employees and related officers of the State or United States or any person involved in administrative government work, who could put conditions on or implement the camera as public work.
The City understands this to be a request for a list of persons who could put conditions on or implement the camera as public work.  The City does not maintain such a listing and therefore there are no responsive records identified for this portion of your request.  However, if you have questions about the use of the cameras, please feel free to contact the Public Works Department at 425-587-3800.
9.  Emails related to the planning, purchasing and work orders for the cameras
The City is in the process of conducting an email search for the terms "Iteris" and "VantageNext" during the time frame of 1/01/16 to 6/30/16.  The City requires additional time to complete the search and assembly for emails using these search parameters and to review any identified emails to determine whether any of the information is exempt from disclosure.
At this time, we believe that either another installment, or the remaining records in response to your request, will be available on or before 8/24/16.  We will provide you with a status report on or before that date.
If staff has misinterpreted any portion of your request, please advise us as soon as possible as it is staff intention to comply with the RCW 42.56 in a timely manner.
Should you have any questions or experience any difficulty in accessing the records via the portal, please feel free to respond to this email through your portal account or call the City Clerk’s Office at 425-587-3190.

Dear Kirkland Public Records,

Thank you for the information you have dutifully provided here.

I intend to follow up with you and to appeal for certain information which may be available under other terms of request. Names and identities of those who have performed work for the city as it pertains to these cameras should be made plain. Who they are any how they came to be involved is very important because the City of Kirkland did and does fail to inform the public of cameras being erected in their neighborhoods without minding community impacts or to negotiate the information being collected at our expense.

Access to this information is important. While it is convenient for the City to post what they will on their own portal with a password gate, I would like copies of these documents as they become available be sent to the MuckRock address given your office. These are public records and should be made plain to the public.

Sincerely,

Sheila Dean

Public Records Request Portal (http://www.kirklandwa.gov/depart/Finance_and_Administration/Public_Records/Public_Records_Request/PRRPortal.htm) Description: TO: [kirklandwa@mycusthelp.net]August 30, 2016City of Kirkland, Public Records Requests c/o City Clerk, Kathi AndersonCity of KirklandAttn: City Clerk/Public Records Officer123 Fifth AvenueKirkland, WA 98033This is a follow up to request number P011118-063016:Dear Kirkland Public Records, Thank you for the information you have dutifully provided here. Sincerely, Sheila Dean ---On Aug. 24, 2016:

RE: Public Records Request: P011118-063016
Dear Ms. Dean:
The City of Kirkland is writing in response to your message dated August 30, 2016.  As previously advised, please note that the kirklandwa@mycusthelp.net is an automated account that is not monitored regularly.  Therefore, please log in to your portal account to respond to messages regarding this request to ensure timely receipt of your correspondence.
To the extent that it appears you are requesting a list of names and identities of those who have performed work for the City as it pertains to these cameras, as previously noted, the City does not have a record that list the names of the employees as it pertains to the specific installation of cameras that is the subject of this request.  However, names of employees involved in the project are included in the records provided to you thus far and have not been exempted or redacted.
Please let us know what records you are intending to follow up on for appeal.  We are still actively working on your request and it is our goal to ensure that we provide the fullest assistance and produce the records you have requested.
In response to your message regarding the access availability regarding the records provided thus far, the access to the records provided via the City’s Records Portal is not restricted with a password gate for this request.  Members of the public may also access the files produced in response to this request without logging in to the City’s Records Portal.

In regard to your request that hardcopies of the records be mailed to MuckRock, we are happy to do so.  However, the City does charge for copy costs in excess of $5.00.  A rough estimate for the copy costs for the records produced thus far is 104 pages x $0.17/page for a total of $17.68.  Please note that this is a preliminary estimate as any attachments to the emails produced thus far has not been calculated.  As there will be a cost associated to production of the records via hardcopy, please clarify if you require a hard copy.
Lastly, we are continuing to work on review of the remaining records in response to your request and have identified records that contain the identification of specific system vulnerabilities in regard to the City’s traffic information system, specifically the operation manual you have requested for the traffic cameras.  In accordance with RCW 42.56.420(4), the City believes that a portion of the requested operation manual is exempt from public inspection.  If you are aware of some alternate citation in the RCW or case law which you believe could reliably be held as argument for release, please do provide it to the City for consideration.
At this time, the City of Kirkland requires additional time to review remaining assembled records to determine whether any of the information is exempt from production.  We believe that either another installment, or the remaining records responsive to your request, will be available on or before 9/28/16.  We will provide you with a status report on or before that date.
Should you have any questions, please feel free to respond to this email through your portal account or call the City Clerk’s office at 425-587-3190.
Respectfully,
Kirkland Public Records

Dear City Clerks Office,

There have been a a series of disconnects between MuckRock administrators, myself and public records administrators in accessing the Kirkland FOIA portal.

The auto generated credentials posted at MuckRock do not work. None of the credentials passed to me have been working credentials to admit me to records. I believe MuckRock may be having similar problems accessing the portal site. In order to functionally get these records online, we need to troubleshoot this.

Are you prepared to provide the responsive documents from this query to other members of the public, other than myself, including but not limited to members of the press, with or without the portal? If so, certain members may be in contact with your office to get digital copies of these records.

Thank you for your willingness to help work out these access problems. I am sure they have a solution.

Best,

S. Dean
