Pursuant to the Kansas Open Records Act (K.S.A. 45-215), I hereby request the following records:

All Stand Your Ground motions that have been filed by defendants in judicial district 3 since January 1, 2006.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 3 business days, as the statute requires.

Mr. Spies:

Pursuant to your email dated April 29, 2017, you asked for a list of all "Stand Your Ground" motions filed in the Third District Court since 2006. Your request did not specify a particular timeframe or case associated with this list. Because the list was not more clearly identified, we must deny your Kansas Open Records Act (KORA) request on the basis of K.S.A. 45-221(a)(1) which allows the Kansas Supreme Court to establish rules regarding exemptions to the disclosure of court records under KORA. Kansas Supreme Court Rule 196 and Administrative Order 189 require us to deny any KORA requests that require us to compile information or respond to a bulk request. Your request clearly falls within these exemptions as presently written.

It should be noted, the Court is not the custodian of records for the District Attorney's office. I do not know whether they compile the specific information you seek.
