Pursuant to the Kansas Open Records Act (K.S.A. 45-215), I hereby request the following records:

All policies, procedures, memorandums of agreements, other memos, directives, communications, occurrence reports, and any other relevant materials regarding the reporting, negotiations, control, aftermath, and general treatment of hostages taken or individuals restrained in a hostage-like manner by individuals detained or under the supervision of facilities maintained under the jurisdiction of this agency, including juvenile, local, and private facilities, if applicable. If additional policies are maintained by other agencies, direction indicating such would be greatly appreciated.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 3 business days, as the statute requires.

I am writing in response to your Open Records Request regarding hostages within correctional facilities, received by our office on Friday, October 23rd.

As detailed in K.S.A 45-221 (45), information that could create a security risk is prohibited from disclosure to the public.

(45)‚ÄÉRecords, other than criminal investigation records, the disclosure of which would pose a substantial likelihood of revealing security measures that protect: (A) Systems, facilities or equipment used in the production, transmission or distribution of energy, water or communications services; (B) transportation and sewer or wastewater treatment systems, facilities or equipment; or (C) private property or persons, if the records are submitted to the agency. For purposes of this paragraph, security means measures that protect against criminal acts intended to intimidate or coerce the civilian population, influence government policy by intimidation or coercion or to affect the operation of government by disruption of public services, mass destruction, assassination or kidnapping. Security measures include, but are not limited to, intelligence information, tactical plans, resource deployment and vulnerability assessments.

The Emergency Response Plans available for the public are found in Chapter 19 of our Policy and Procedure Plan.
