Pursuant to the New York State Freedom of Information Law (1977 N.Y. Laws ch. 933), I hereby request the following records:

Any and all police or incident reports or portions thereof pertaining to the occurrence of the following at Ithaca High School:
- Sex crimes
- Assaults
- Robberies
- Weapons
- Shots fired

Records requested date from January 1, 2009 up to January 1, 2013.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Our FOIL Record No. 1190

Dear Mr. Stein:

Please be advised that your FOIL request wherein you
requested “…police or incident reports… pertaining to the occurrences of
the following at Ithaca High School… sex crimes, assaults…” has been
granted in part and denied in part.

Please be further advised, however, that portions of the
reports (i.e., names and personal information of victims, witnesses and
persons not charged) have been withheld on the ground that disclosure
would constitute an unwarranted invasion of personal privacy in
accordance with §87(2)(b) of the Public Officers Law. When more than
two hours of time is spent extracting and preparing electronic data or
records, an agency is permitted to charge a fee in the amount equal to
the hourly salary attributed to the lowest paid agency employee who has
the necessary skill required to extract the requested data.

The responsive documents requiring redaction total 75 pages. Due to the
volume of responsive reports, we estimate approximately three hours of
work to complete this request. At $22.63 per hour for three hours, the
charge for the extraction and preparation time is $67.89. We require
that you pay for the records prior to redaction and copying.
Accordingly, please send a check in the amount of $67.89, payable to the
City of Ithaca, to the City Attorney's Office, 108 East Green Street,
Ithaca, New York 14850, and the documents will be redacted, copied, and
mailed to you. Please contact Jody Andrew, Executive Assistant, at (607)
274-6504 or at jandrew@cityofithaca.org to make arrangements ahead of
time, if you wish to pick up the records in person. In-person pickup,
once arranged by phone with this office, is made from the City Clerk's
Office with cash or check only between the hours of 8:30 a.m. – 4:00
p.m.

If you wish to appeal this decision, you may do so in
writing to the Mayor, at 108 East Green Street, Ithaca, New York 14850,
within thirty (30) days.

and the Clerk’s office that the request you mention of Jan. 1st was not
received by either of their offices. At this time, the request has been
forwarded to the City Clerk’s office to be processed as a FOIL request.
