Pursuant to the Iowa Open Records Law, I hereby request the following records:

AtNight Media (formerly Original Media Group) requests material relating to the investigation into the disappearance and murder of Mollie Cecilia Tibbetts.

On July 18, 2018, University of Iowa student Mollie Cecilia Tibbetts disappeared while jogging near her home in Brooklyn, Iowa.

A month later, police identified 24-year-old Cristhian Bahena Rivera as a suspect in connection with the disappearance; surveillance footage showed Rivera's car following Tibbetts on her jog. Rivera led police to the body of Tibbetts in a Poweshiek County cornfield on August 21.

He was charged with first-degree murder. On May 28, 2021, Rivera was found guilty of first-degree murder.

Request.
1. Notes, photos, video or audio recordings gathered during the multiple search of Cristhian Bahena Rivera’s residence, bodycam of his arrest and crime scene photographs and video.
2. Any memos, documents, reports, video and other material the Agency would generally provide to the public through members of the media relating to “Mollie Cecilia Tibbetts” and “ Cristhian Bahena Rivera.)

AtNight Media is a representative of the news media and is primarily engaged in the dissemination of information to the public.

The Iowa Division of Criminal Investigation has received your open records request in reference to the Mollie Tibbitts investigation. The DCI’s investigative reports are protected from disclosure pursuant to Iowa Code 22.7(5). What is public record are the immediate facts and circumstances as well as anything investigative that was used in or during court proceedings. The DCI does not keep track of items that are entered into evidence during court proceedings and for those records you can try contacting the Poweshiek County Attorney’s office or the Poweshiek Clerk of Court office.
