Pursuant to the Indiana Access to Public Records Act, I hereby request the following records:

Policies, procedures and/or training documents pertaining to the execution of death row inmates.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Ms. Hopkins: Attached are copies of documents responsive to your request for public records. The documents have been redacted to remove any information which could identify the identities of any persons who assist in carrying out the process, any internal communication information, and any information related to specific facility movement. To the extent any information would identity any person who would assist in any way in the execution process, it is confidential pursuant to Indiana Code 35-38-6-6 which allows the Department of Correction to keep confidential the identities of persons who assist in the execution. The records are also exempted from disclosure pursuant to Indiana Administrative Code 210 IAC 1-6-2(3)(C) which prohibits the release of information which might result in physical harm to another person. Finally, to the extent release of the information may impact communications or movement related to the execution process, the information is non-disclosable pursuant to Indiana Code 5-14-3-4(b)(8) because the records would represent administrative information that would jeopardize a security system.
