Pursuant to the Illinois Freedom of Information Act., I hereby request the following records:

All malfunction forms, often known as Startup, Shutdown or Malfunctions or SSM events, submitted by Koppers Inc. from Jan. 1, 1970 to the date this request is ultimately fulfilled. An example of such a form is publicly posted by the IEPA: https://epa.illinois.gov/content/dam/soi/en/web/epa/documents/epa-forms/air/aer/malfunction.pdf

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Hi Sharon and AJ,

This response is just one single SSM report for in December 2023, though I requested all SSM events "submitted by Koppers Inc. from Jan. 1, 1970 to the date this request is ultimately fulfilled." I have seen Koppers reference SSM events they declared in older Notice of Violations, which leads me to believe there are many more than this single one I recieved. Is it that this is truly the only SSM they have ever submitted or was there a misunderstanding?

I did check with the Bureau of Air and was informed the document provided in the FOIA response was the only document in our report tracking system identified as an SSM report.
