Pursuant to the Illinois Freedom of Information Act., I hereby request the following records:

All permitting documents submitted to the Department of Transportation between 1/1/2023 and 12/15/20223 for installation of automated license plate readers.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Please be advised that the Illinois Department of Transportation is unable to respond to your request within the five (5) working days and is extending the response time by an additional five (5) business days pursuant to the Illinois FOIA at 5/140 Section 3(e). The reason for the delay is as follows:

I am writing in regard to your FOIA request received by the Illinois Department of Transportation. As written, responding to your request would create an undue burden on the operation and resources of the Department. The Freedom of Information Act, 5 ILCS 140/1, states, in part the "Act is not intended ... to disrupt the duly-undertaken work of any public body..." and that requests "calling for all records falling within a category shall be complied with unless compliance with the request would be unduly burdensome for the complying public body and there is no way to narrow the request and the burden on the public body outweighs the public interest in the information. Before invoking this exemption, the public body shall extend to the person making the request an opportunity to confer with it in an attempt to reduce the request to manageable proportions." 5 ILCS 140/3(g).

Accordingly, I am inviting you to limit the scope of your request to manageable proportions. Specifically, there are nearly 1500 pages of permitting records for the year 2023. Previewing and redacting this many files creates a burden on the FOIA Office. Please limit the scope of your request to a specific location or a shorter timeframe to search.

Once we receive your response, we will conduct a new search and respond with any relevant requested information.
