Pursuant to the Illinois Freedom of Information Act., I hereby request the following records:

1) All statements of work, RFP submission packets, sole source agreements, data sharing agreements, and contracts between the university and Concourse Global Enrollment since Jan. 1, 2016.

2) All contractually required performance reports (e.g., annual reports, end-of-contract reports, etc.) submitted to the university by Concourse Global Enrollment since Jan. 1, 2016.

3) All user handbooks, university policies, and technical manuals for Concourse Global Enrollment products used by the university.

4) Data dictionaries/libraries for all Concourse Global Enrollment database products used by the university. To clarify: Data dictionaries/libraries list the categories and structure of data in a database, they do not contain the actual data.

I ask that all fees be waived as I intend to use the requested records to publish articles in the public interest and not for any commercial purpose. In the event you choose to impose fees, I request a detailed breakdown of the fees, including the hourly wage of each employee involved and an explanation justifying the employee hours required to fulfill the request.

Should you choose to reject this request or redact portions of it, I ask that you provide a detailed explanation and citations to the statutory exemptions and associated case law underlying your decision to withhold each/any portions from public review.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Dear Mr. Feathers:

On September 26, 2022, the University received your request for the following:
1) All statements of work, RFP submission packets, sole source agreements, data sharing agreements, and contracts between the university and Concourse Global Enrollment since Jan. 1, 2016.
2) All contractually required performance reports (e.g., annual reports, end-of-contract reports, etc.) submitted to the university by Concourse Global Enrollment since Jan. 1, 2016.
3) All user handbooks, university policies, and technical manuals for Concourse Global Enrollment products used by the university.
4) Data dictionaries/libraries for all Concourse Global Enrollment database products used by the university. To clarify: Data dictionaries/libraries list the categories and structure of data in a database, they do not contain the actual data.
Your request is granted in part and denied in part.

Regarding request 1, the University does not have a contract or other requested documents with Concourse Global Enrollment. The University does have an agreement with an entity that uses Concourse Global software. As a courtesy, we are attaching that agreement.

Signatures have been redacted from the document, as signatures are considered private information (5 ILCS 140/2(c-5)), exempt from disclosure pursuant to 5 ILCS 140/7(1)(b).

Regarding requests 2-4, the University does not have any documents responsive to these requests.

You have a right to have this request reviewed by the PAC at the Office of the Illinois Attorney General (5 ILCS 140/9.5(a)). You may file your Request for Review with the PAC by writing to: Public Access Counselor, Office of the Attorney General, 500 South 2nd Street, Springfield, IL 62706, fax: 217-782-1396 (e-mail: publicaccess@atg.state.il.us<mailto:publicaccess@atg.state.il.us>).

You also have the right to seek judicial review of your request by filing a lawsuit in the State circuit court (5 ILCS 140/11).

If you choose to file a Request for Review with the PAC, you must do so within 60 calendar days of the date of this denial letter (5 ILCS 140/9.5(a)). Please note that you must include a copy of your original FOIA request and this response letter when filing a Request for Review with the PAC.
