Therefore, I hereby request the following records:

1) All presentations and presentation materials (including recorded video and audio, PowerPoint files, prepared remarks, and slides formats), and other information presented to the university/University Police Department about Starship/Starship robots.

2) A copy of any incident reports relating to Starship delivery robots, including attachments and media.

3) Any emails between the university and other members of the University about or mentioning Starship delivery robots, including attachments and media.

4) Any emails between the university and employees of Starship.

5) Any resident /student complaints about Starship robots or other delivery robots.

6) Any requests for evidence, subpoenas, or other legal requests about Starship.

7) Any video footage or audio given to the university or university police department by Starship

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

The request form requires the person requesting the records to include information omitted from the request you submitted through MuckRock News, such as the requester’s address, email address and phone number, and the name of the company or organization on whose behalf the request is submitted. See Idaho Code § 74-102.

Additionally, please be as specific as possible when requesting the records. Per Idaho Code § 74-102, “’[t]he requesting party shall be as specific as possible when requesting records. A request shall describe records sought in sufficient detail to enable the [University] to locate such records with reasonable effort.” Please be advised that the University charges a copying fee for each page after the 100th page of responsive records and, when the actual labor associated with responding to the request would exceed two person hours, the requester may be charged for the additional labor. Further, when requested records contain nonpublic information that must be deleted, the requester may be charged actual labor costs associated with redacting the nonpublic portions of the records.
The University will begin to process your request once you have resubmitted it with proper information.

The University’s Office of General Counsel has reviewed your October 25, 2023, public records request. Based on that review, the University is granting your request to the extent of the attached records. These records are responsive to items 2 and 5 in your request and include incident reports and logs from the Campus Security Team. In summary, there were 19 relevant case numbers. A few of these correspond to incidents; the remainder are log entries that reference one of the incidents or identify an area were someone was patrolling. If you have questions about these documents, please let me know. Please note I redacted one of these documents to remove a student’s name. Your request was, therefore, denied to the extent of this redaction because student information is exempt from disclosure under Idaho Code § 74-104(3), and the Family Educational Rights and Privacy Act (FERPA), 20 U.S.C. § 1232g, and its implementing regulations, including 34 C.F.R. § 99.30. If you disagree with this denial, your sole remedy is to is to institute proceedings in the district court of the county where the records, or some of them, are located, to compel the University to make the information available for public inspection. The petition contesting the decision must be filed within 180 calendar days from the date of mailing of this notice of denial or partial denial.

As to item nos. 1, 6, and 7, it appears the University has no responsive documents. While the Starship robots do operate on campus, the University has no contractual relationship with Starship. Further, the University does not have its own police department but instead is served, along with the rest of the Moscow community, by the Moscow, Idaho Police Department.

The University is still working on item nos. 3 and 4 in your request. These were for: “3) Any emails between the university and other members of the University about or mentioning Starship delivery robots, including attachments and media,” and “4) Any emails between the university and employees of Starship.” I have asked the University’s IT staff to search email accounts for these types of records. The request, as worded, is extremely broad and I expect it may yield voluminous documents. For example, as presently worded, the request would implicate even purely personal email discussions between faculty or employees along the lines of “I just saw a Starship robot for the first time!” or “I’m going to place a food order with the Starship robots. Do you want anything?” Would it be possible for you to narrow your request as to items 3 and 4? For example, you might rephrase the requests to seek only Starship-related email discussing a particular subject (e.g., hypothetically, to emails that reference a robot injuring someone or damaging property). If you do not wish to rephrase as to item nos. 2 and 3, that’s fine. Just be aware that the University is authorized to charge, and does charge, for labor and copying costs when a request: (1) yields more than 100 pages of records, (2) includes records from which nonpublic information must be redacted, or (3) involves more than two hours of responsive labor. See Idaho Code § 74-102(10). Where a request meets one or more of these criteria, the University will estimate its time and costs to search for, gather, review, and if necessary, redact the records. The requester is then required to pay the estimated costs before the University performs further work. See Idaho Code § 74-102(12).
