Pursuant to the Massachusetts Public Records Law, M.G.L. c.66, §10, I hereby request the following records:

* All policies, procedures, and training records regarding cooperation with Immigration and Customs Enforcement

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

This email is in response to your public records request of April 18, 2017. You requested “All policies, procedures, and training records regarding cooperation with Immigration and Customs Enforcement.” Below is from our Policy and Procedure:

From Policy and Procedure 4.1.1 Protocol 19-O

O. Immigration Detainers: Our ICE policy has been modified to allow ICE notifications and ICE detainers with conditions.

1. HCSD will honor ICE form I-247N which ICE will forward to us requesting we notify them pending an inmates release. We will make every effort to notify ICE of an impending release. Some releases make it impossible to notify ICE beforehand (releases at court). If ICE, upon notification, suggests they would like to pick up the inmate, they need to be here before an inmates release to the public, as there will be no delays in the inmates release procedure.

2. We will honor ICE form 1-247D only when accompanied by a federal warrant or a judicial order. We will hold for 48 hours(inclusive of weekends and holidays). Time will commence when inmate is handed the “Notice to Detainee.”

Copies of ICE forms will be attached to court mitts when inmates are conveyed to court.
