Pursuant to the Georgia Open Records Act, I hereby request records related to student predictive analytics services used by the district.

For the purpose of this request, the term "student predictive analytics services" means software or computer code that employs machine learning models to generate predictions about individual students or groups of students for one or more of the following purposes:

a) To generate predictions about students' likelihood of dropping out or graduating (these tools are sometimes called early warning systems).
b) To generate predictions about students' likely performance in individual classes, honors or AP programs, and/or on standardized tests (including state assessments, the ACT, SAT, etc.).
c) To generate predictions about students' attentiveness and/or emotional wellbeing.
d) To generate predictions about students' behavior and/or safety (e.g. whether a student is at risk of harming themselves or others).
e) To generate predictions that are used to determine whether students are placed in certain schools, programs, and/or classes.
f) To generate predictions about academic integrity (e.g. test proctoring software and generative AI detection).

My request applies to student predictive analytics services used by the district during the 2022-23 academic year, including those developed in-house by the district, purchased from a vendor, or provided by another agency (e.g. the state department of education or a university).

For each student predictive analytics service the district used during the 2022-23 academic year, I request:

1) All active contracts, statements of work, and data sharing agreements between the district and the provider regarding the student predictive analytics service.

2) Records defining the input variables and their weights/relative power for each predictive model used by the district during the 2022-23 academic year (In other words, records defining the data points fed into each predictive model and their respective impacts on the model's output).

3) Records documenting the accuracy (AUC, true/false positive, specificity, lift, etc.) of each predictive model the district used during the 2022-23 academic year.

4) Any validation studies, disparate impact studies, or other records documenting how the student predictive analytics services the district used during the 2022-23 academic year performed across different student groups (e.g. Black students vs. Hispanic students, male students vs. female students).

I ask that all fees be waived as I am a journalist and intend to use the requested records to publish articles in the public interest about the operations of a government agency. If you choose to impose fees, I ask that you provide an explanation of the fees, including the hourly wage of the lowest-paid employee capable of fulfilling the request.

If you choose to reject this request or redact portions of responsive documents, I ask that you cite the statutory exemptions and associated case law underlying your decision to withhold each portion from public review.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

In response to your Open Records Request, there is limited use of predictive modeling in the school district. However, please see the estimate below for the information we presently maintain:

* 2-3 hours @ $50 per hour to retrieve/redact (less 15 minutes per O.C.G.A. §50-18-71 (c) (1))

* 0 copies @ $.10 per copy. Information will be provided electronically.

This amount is based upon the salary of the lowest paid, full-time employee who has the necessary skill and training to fulfill this request. Please be reminded this is an estimate. The actual time taken to retrieve and redact the requested information and the number of copies requested will be tracked and the cost will be adjusted accordingly.

Upon your written approval of the estimated costs, we will proceed with the retrieval and redaction process. The following information/documents will be redacted in accordance with the codes specified below (if applicable):

1. Records specifically required by federal statute or regulation to be kept confidential pursuant to O.C.G.A. §50-18-72 (a)(1).

1. Medical records and similar files, the disclosure of which would be an invasion of personal privacy pursuant to O.C.G.A. §50-18-72 (a)(2).

1. Records that reveal an individual’s social security number, mother’s birth name, credit card information, debit card information, bank account information, account number, utility account number, financial data or information, insurance or medical information in all records, personal email address or cellular telephone number, and day and month of birth pursuant to O.C.G.A. §50-18-72 (a)(20)(A).

1. Confidential evaluations and transcripts in accordance with O.C.G.A. §50-18-72 (a) (1), (7) and O.C.G.A. §20-2-210 (a)(e)(1), and 20 U.S.C. §1232g (b) (1) and (4) (B).

1. Confidential tax matters in accordance with O.C.G.A. §50-18-72 (43).

1. Records subject to the client attorney privilege and confidential attorney work product pursuant to O.C.G.A. §50-18-72 (a)(41) and (42).

1. Any record that would not be subject to disclosure, or the disclosure of which would jeopardize the receipt of federal funds, under 20 U.S.C. §1232g or its implementing regulations pursuant to O.C.G.A. §50-18-72 (a)(37).

1. Any records or documents that may compromise the safety of GCPS or students served pursuant to O.C.G.A. §50-18-72 (25) (a) (I) (II) (III) (IV) (V), O.C.G.A. 20-2-1185 School Safety Plan.

1. Juvenile law enforcement records pursuant to O.C.G.A. §15-11-708(b).

1. Records of student disciplinary hearings pursuant to O.C.G.A. §20-2-757(b).

1. Juvenile court adjudication records pursuant to O.C.G.A. §20-2-671 & O.C.G.A. §20-2-751(d)

1. Any trade secrets obtained from a person or business entity that are required by law, regulation, bid or request for proposal to be submitted to an agency O.C.G.A. §50-18-72(34).

1. Drug and alcohol test results pursuant to O.C.G.A. §50-18-72 (a)(1) & 49 C.F.R. §40.321.

1. No public officer or agency shall be required to prepare new reports, summaries, or compilations not in existence at the time of the request O.C.G.A. §50-18-71 (j).

1. Records of benefit selections, payroll deductions, and other individual account information pursuant to O.C.G.A. § 45-18-53(b).

1. Confidential fingerprint and criminal background information in accordance with O.C.G.A. §35-3-34.2(k) and O.C.G.A. §35-3-38(a).

1. Investigatory materials that are evidence of an alleged violation of Part 2 of Article 3 of Chapter 12 of Title 16 and are in the possession, custody, or control of law enforcement, prosecution, or regulatory agencies pursuant to O.C.G.A. §50-18-72(32).

1. Records concerning reports of child abuse pursuant to O.C.G.A. §19-7-5(i) and O.C.G.A. §49-5-40(b)

Upon receipt of your written approval of the cost estimate the redacted information will be available within 14 business days.

Once the retrieval/redaction process has been completed, we will forward you an email with the actual costs associated with your request, instructions for submitting payment, and the date/time the documents will be available for pick up.
