Pursuant to the New York Freedom of Information Law, I hereby request the following records:

I am seeking all records related to the American Academy of Pediatrics (AAP) and the Council on School Health (COSH), including any communications or correspondence between the school district and these organizations, or any other party that may have provided information to the district from these organizations.

To help identify responsive records, you can limit your time period to 1/1/2017 until the date of final response; also I request that you search for the following terms, which are focused on the American Academy of Pediatrics and its affiliated organizations:

"American Academy of Pediatrics"
"AAP"
"Council on School Health"
"COSH"
"pediatric"
"child health"
"school health"

Please include records of any type, including but not limited to emails, letters, memoranda, reports, meeting minutes, presentations, and any other records of communication or correspondence between the American Academy of Pediatrics, the Council on School Health, and the school district or any other party that may have provided information to the district from these organizations.

If no records are responsive to this request, please provide a certification of that fact pursuant to Public Officers Law ยง89(3), and inform me of the district's obligations under LGS-01 to retain records until any appeal has been resolved.

If any records are withheld, please provide an explanation of the legal basis for the withholding.

If my request is denied in whole or in part, please provide a written explanation of the reasons for the denial.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

I am writing in response to your recent communications regarding my Freedom of Information Law (FOIL) request dated March 7, 2023. I appreciate your efforts in identifying over 16,000 emails that may be potentially responsive to my request. However, I would like to clarify a few points to ensure a comprehensive and compliant response to my request.

Firstly, I understand that the identified emails need to be reviewed to determine which ones contain potential education records and which ones do not, as per Public Officers Law 87(2)(a) and 20 U.S.C. 1232g, or interagency documents under Public Officers Law 87(2)(g). I also acknowledge that certain emails may be precluded from disclosure under Public Officers Law ยง87(2)(a) (C.P.L.R. ยง3101(c), and C.P.L.R. ยง4503(a)). However, it is important to note that these regulations do not necessitate the wholesale removal of emails. Rather, they require specific redactions of sensitive information while leaving intact factual or other information that aligns with relevant redaction scopes.

In light of this, I would like to request that the School District ensures that redactions are specific and do not result in the removal of entire emails that contain responsive factual information not covered under the exemptions mentioned. The redaction process should be conducted in a manner that respects the principles of transparency and accountability, as outlined in the New York State Freedom of Information Law.

Secondly, I would like to clarify that the 16,000 emails identified are indeed responsive to my request. The wording in your response suggests a conflation between the terms "responsive" and "redacted". I understand that the School District is reviewing these emails to determine which ones require further redaction, not to determine their responsiveness.

Lastly, I would like to request a rolling response to my FOIL request. Given the large number of emails identified, it would be beneficial to receive the emails in batches as they are reviewed and redacted, rather than waiting for the entire batch to be processed. This would allow for a more timely and efficient review of the information.

I appreciate your attention to these matters and look forward to your continued cooperation in fulfilling my FOIL request. Please feel free to contact me if you require any further clarification or information.
