According to the Georgia Department of Public Safety website, "The Georgia 1033 Program enables Georgia Law Enforcement agencies to participate in this program and acquire DoD excess equipment to support law enforcement activities under the Federal Guidelines 10.U.S.C. 2576a": https://dps.georgia.gov/services/excess-property/1033-excess-property-program-overview

Pursuant to the Georgia Open Records Act, I hereby request the following records:

- Documents sufficient to show all Georgia law enforcement agencies who have participated in the Georgia 1033 Program.
- Documents sufficient to show all Annual Certifications completed between 10/1/22-10/31/22 and 10/1/21-10/31/21, according to the terms listed on the Georgia Department of Public Safety website.
- All Documents constituting, reflecting, relating to or that contain current use policies if any for each type of 1033-program controlled equipment, including situations or circumstances in which use is authorized or prohibited.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Good afternoon,

Your request is in progress. The 1033 program is over twenty years old and there are over 300 agencies enrolled. Please consider narrowing your request to a particular agency or consider providing a timeframe.

As it stands, it will take a minimum of eight hours to manually go through hundreds of documents to determine #1 which agencies have participated in the program. The production tasks will be charged at $25.00 ($200.00) plus $.25 per page if redactions are required. The charges provided are not copy fees. They constitute a sum which is lower than the pro-rated salary for search, retrieval, review, redaction, and production by each of the lowest paid full-time employees who, in the reasonable discretion of DPS, has the necessary skill and training to locate and provide responsive documents in each category listed. Please see O.C.G.A. § 50-18-71(c)(1).

Regarding #2 “documents sufficient to show all Annual Certifications completed between 10/1/22-10/31/22 and 10/1/21-10/31/21, according to the terms listed on the Georgia Department of Public Safety website” we have no available, releasable documents responsive to your request.

We have 23 pages of documents that are responsive to #3 “documents constituting, reflecting, relating to or that contain current use policies if any for each type of 1033-program controlled equipment, including situations or circumstances in which use is authorized or prohibited”. The cost is $5.75.

Prepayment is required for DPS to begin production because MuckRock has outstanding charges for this Department’s prior production of documents. See O.C.G.A. § 50-18-71(d).

Please advise if you want to narrow #1 to timeframe or agency or let us know if you intend to pay a minimum of $200.00 for the production tasks. We will then provide a time estimate once the records are pulled along with an updated invoice if redactions are required. Once that invoice is paid, we will provide a time estimate and begin redacting the records. Lastly, please advise if you want you only want to pay $5.75 for #3.

Please let us know if you are revising #1, paying a minimum of $200.00 for #1, paying $5.75 for #3 or $205.75 for both #1 and #3 so we may prepare an invoice. If we don’t hear from you within two weeks, this request will be closed.
