Pursuant to the Georgia Open Records Act, I hereby request the following records:

-The records previously released to the Athens Banner-Herald pursuant to a ruling and subsequent agreement made between that newspaper and the University of Georgia Athletic Association in Clarke County Superior Court, case SU21CV0558.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 3 business days, as the statute requires.

This is to acknowledge receipt of your March 15, 2023, request for documents under the Georgia Open Records Act, and is in accordance with the three-day period of response pursuant to O.C.G.A. § 50-18-71(b)(2).

You have requested “The records previously released to the Athens Banner-Herald pursuant to a ruling and subsequent agreement made between that newspaper and the University of Georgia Athletic Association in Clarke County Superior Court, case SU21CV0558.”

Because you have requested records of the University’s intercollegiate sports program, I have forwarded it to the University’s Athletic Department for an assessment of the scope of potentially responsive documents, estimation of the costs to search for and produce responsive records, and consideration of potentially applicable exemptions.

A written response to your request will arrive within the time-period specified in O.C.G.A. § 50-18-71(d.1).

Mr. Taylor,

I respectfully challenge the determination you have made in processing my request. While I am requesting records that originated with the University's intercollegiate sports program, I am of the belief that such records are in the custody of the Open Records Manager.

Upon information and belief, your office retains records of public records requests received and *your office's responses to each request, including any records disclosed to the requestor*, for 3 years, in compliance with the University System of Georgia's record retention policy.

The Athens Banner-Herald previously requested certain University of Georgia Athletic Association (UGAA) records on August 2, 2021 (#21-371). On November 2, 2021, you denied this request. In October 2022, the Athens Banner-Herald made a "Renewed Open Records Request" directly to the UGAA. This request was fulfilled in March 2023 pursuant to court order.

It is unclear if your office is responsible for retaining records relating to the ABH's October 2022 request. If your office does currently hold these records, you have incorrectly claimed that my request falls under the scope of O.C.G.A. § 50-18-71(d.1), and I would ask that you process my request under the standard parameters of the Georgia Open Records Act.
