Subject: Freedom of Information Act (FOIA) Request – Communications Between DDS and Apple Inc. Regarding the Digital Driver's License System in Georgia

Dear FOIA Officer,

Under the provisions of the Freedom of Information Act, 5 U.S.C. § 552, I hereby request access to and copies of all records held by the Department of Driver Services pertaining to any communication between DDS and Apple Inc. regarding the development, implementation, or management of the Digital Driver's License system in Georgia, including data privacy measures.

For the purpose of this request, the records I seek include, but are not limited to:

- Any written correspondence, including letters, emails, memoranda, and faxes, exchanged between the Department of Driver Services and Apple Inc. regarding the Digital Driver's License system between January 1, 2019, and the date of processing this Open Records Act request.

- Any meeting minutes, agendas, or summaries of meetings, including phone or video conferences, held between representatives of the Department of Driver Services and Apple Inc. regarding the Digital Driver's License system during the same period specified above.

- Any contracts, agreements, or memoranda of understanding entered into between the Department of Driver Services and Apple Inc. regarding the development, implementation, or management of the Digital Driver's License system.

- Any reports, presentations, or studies prepared by Apple Inc. or shared with the the Department of Driver Services pertaining to the Digital Driver's License system.

- Any policies, guidelines, or directives issued by the Department of Driver Services in relation to the use of Apple Inc.'s technology or services for the Digital Driver's License system.

- Any documents or communications that detail the measures or strategies put in place by the Department of Driver Services in partnership with Apple Inc. to ensure the privacy of personal data in the Digital Driver's License system.

Should any portion of the requested records be deemed exempt from disclosure, I request the release of any reasonably segregable non-exempt portions in accordance with 5 U.S.C. § 552(b). If an entire document is exempt, I request a justification, citing specific FOIA exemptions, and provision of an exemption log as per Vaughn v. Rosen, 484 F.2d 820 (D.C. Cir. 1973).

Please note your obligation under the law not to destroy any records potentially responsive to this request. Any withholding, redaction, or destruction of responsive records without proper justification constitutes a violation of the FOIA and is subject to litigation, as confirmed in Kissinger v. Reporters Committee for Freedom of the Press, 445 U.S. 136, 150 (1980).

Enclosed is a letter requesting a fee waiver for the processing of this request. As an independent investigative journalist associated with TransparencyReport.pw, I believe that the information I seek is in the public interest and its disclosure contributes significantly to public understanding of the operations or activities of the government.

If the enclosed waiver is not accepted and there are any potential charges in excess of $200 associated with fulfilling my request, please inform me in advance.

As stipulated by the FOIA, I look forward to your response within twenty business days (5 U.S.C. § 552(a)(6)(A)(i)).

DDS has determined that we have records responsive to your request. Certain records are subject to redaction pursuant to O.C.G.A. 50-18-72. The estimated cost to produce the requested records is $1,903.10. See estimate attached. Since the cost estimate is more than $500, you must pre-pay the estimated costs before DDS retrieves and produces the requested records. Charges must be accepted by return email within three business days of this email, or the request will be deemed abandoned.

Once charges are accepted, the invoice must be paid within 30 days, or the request will be deemed abandoned.

Please make all checks payable to “The Georgia Department of Driver Services” and enclose a copy of this invoice with payment when mailed to: PO Box 80447, Conyers, GA 30013.

The estimated timeframe to produce these documents after the invoice is paid is 10 business days.
