Good Afternoon,
This office does not maintain records responsive to your request.

You may wish to review the laws in Georgia in regard to weapons and licensing. Those laws may be found generally at O.C.G.A. § 16-11-120 through O.C.G.A. § 16-11-135 and O.C.G.A. § 16-11-171 through O.C.G.A. § 16-11-173.

You may also wish to check with the Georgia Bureau of Investigation which may have information or statistics in regard to criminal offenses involving firearms.

Note that weapons carry licensing is handled by probate judges of each of the counties in Georgia and dissemination of information in that regard is governed by O.C.G.A. § 16-11-129.

Thank you,
Rebecca Dobras

To Whom It May Concern:

Pursuant to the Georgia Open Records Act, I hereby request the following records:

Any and all policies, procedures, directives, memorandums, and any other guiding materials regarding matters pertaining to firearm acquisition, licensure, use, and transfer, including, but not limited to, the following:
• policies and procedures on the issuance of firearms permits and licenses. (Please note that this point is not a request for the identities of individual permit or license holders, but, rather, is a request for governmental policies and parameters regarding the process and regulations by which one may obtain either a permit or a license. If separate strictures exist for each, provision of both would be greatly appreciated.)
• policies and procedures on the revocation of firearms permits and licenses.
• any and all available policies and procedures regarding local firearms policies. Please provide all such materials that alter or supplement departmental procedures.
• policies and procedures regarding the sale and purchase of firearms. Please include all materials regarding the appropriate qualifications for the sale or purchase of firearms. Please include materials for particular venues, if available, including but not limited to the sale and purchase of firearms at gun shows.
• policies and procedures regarding the transfer, either out-of-state or between individuals, of firearms.
Please include all available segregable data.
Please also provide all available data, statistics, or reports regarding matters pertaining to gun acquisition, licensure, use, and transfer, including, but not limited to, the following:
• the issuance of firearms permits and licenses.
• the revocation of firearms permits and licenses.
• incidents involving the use of a firearm.
• the sale and purchase of firearms.
• the transfer, either out-of-state or between individuals, of firearms.
If various policies or reports exist dependent on the type of firearm, provision of all applicable materials would be greatly appreciated. Should they be voluminous, provision of materials on rolling basis would be greatly appreciated.
Should your agency believe that any additional policies, procedures, reports or other analysis pertaining to firearm acquisition, licensure, use, transfer, deaths, incidents, or any related issues may reside with another agency or agencies, indication of such agencies would be greatly appreciated.
Please notify us if further clarification is necessary.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 3 business days, as the statute requires.

Dear Ms. Curtis,

I have reviewed your request below and have determined that the GBI may have records responsive to: incidents involving the use of a firearm.

Please provide me with the time frame (month or year) and location (county, metro area, etc.) you would like statistics from. Also, the statistics that will be provided will be those submitted to the GBI Georgia Crime Information Center (GCIC) Uniform Crime Report (UCR) by agencies in the State of Georgia. I look forward to hearing back from you.

Sincerely,

SAC Lisa Harris

Hello Ms. Harris,

Thanks so much for your response. It would be great to begin with all data from 2015 from each county. We're ultimately interested in a larger span of time, but perhaps this is a manageable period to start with. Could you let us know if that sounds doable?

Have a great weekend!

From: Harris, Lisa

Dear Ms. Curtis,

I apologize, I failed to forward your request to GCIC. I have hand delivered it this morning and they are working on it now. I will forward it to you as soon as they get it to me. Thank you for following up with me!

Sincerely,
Lisa

Dear Ms. Curtis,
I am going to forward you the stats under a separate e-mail. Thank you!

From: Harris, Lisa

Dear Ms. Curtis,

Here are the stats you requested. This is how they are reported, so that is why there are three spreadsheets showing the crimes reported committed with a gun. Please let me know if you need anything further.

Sincerely,
Lisa

Hi Lisa,
I do actually have one final question. In the column labeled 'County,' are the numbers the county code (i.e. 19 is Calhoun County)? Thanks in advance!
Best,
Caroline Curtis

From: Harris, Lisa

Yes mam!

From: Caroline Curtis

Thank you! And one final question- I was wondering where I might be able to find a list indicating which codes apply to which counties. I have found a few online, but there have been discrepancies between them.
Thank you again!

Hi Lisa,
I wanted to thank you again for the 2015 statistics, they're extremely helpful! I was wondering if it might be possible to get any more granular data, like age/sex/race for the crimes broken down by county, as well as any forms or information regarding policies and/or procedures for reporting these crimes. I'm not necessarily looking for anything that may be identifying, more so a general information.

Thanks so much for your help!
Best,
Caroline Curtis

From: Harris, Lisa

I have sent it over to GCIC to let the Programmer look at it to see if it can be done. Thank you!

From: Harris, Lisa

Dear Ms. Curtis,

I checked with GCIC and they advised that the incidents reported are reported on a Return A, and the Return A does not capture age, sex, or race. Thank you!

From: Caroline Curtis

Hi Lisa,
Thanks again! One final question- is it possible to receive any forms, documents, information regarding requirements, policies and/or procedures for reporting these types of crimes. ]

Additionally, since the GCIC Return A does not capture age/sex/race, could you provide any idea of where I might be able to find this information? I know that the GBI site has the UCR data for crime statistics summary reports, but only lists up to 2014. I am open to exploring other agencies.

Thanks!
Caroline Curtis

Hi Lisa,
Thanks for your help with previous requests. I was hoping to receive any requirements for reporting homicides, robberies and assaults? If there are different procedures for reporting those crimes with involvement of a firearm I would be interested in that. And to that, If there are any documents, policies, etc. concerning repercussions for not reporting said crimes, if there are any at all.

Thank you!
Caroline Curtis

There are GCIC Council Rules and there are instructions on entries, possibly in a user manual. I am forwarding your request over to GCIC to get the appropriate documents. I am out of the office today, and will return tomorrow. I will update you then. Thanks!
