To Whom It May Concern:

Pursuant to the Florida Sunshine Law, I hereby request the following records:

All communications in your possession, of any type whatsoever, to and from the Trump Organization and any Trump Organization subsidiaries or their agents regarding tax abatements, exemptions, subsidies, or reductions on their real or personal property.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I would request your response within ten (10) business days.

Sincerely,

From: Florida Department of Revenue

Mr. Nesbitt,

The Florida Department of Revenue ("Department") received your public records request via electronic transmission on March 14, 2018, for the following:

"All communications in your possession, of any type whatsoever, to and from the Trump Organization and any Trump Organization subsidiaries or their agents regarding tax abatements, exemptions, subsidies, or reductions on their real or personal property."

This will serve to acknowledge and respond to your request. As you may not be aware, the term "Trump Organization and any Trump Organization subsidiaries or their agents" may potentially encompass over 400 possible business entities. Consequently, the request received is overly broad and insufficient to identify to the Department the specific business entities for which your request may potentially apply.

In addition, Florida law [section 213.053(2)(a), Florida Statutes] maintains that taxpayer information contained in returns, reports, accounts, or declarations received by the Department is confidential except for official purposes and exempt from section 119.07(1), Florida Statutes. To the extent they exist, Florida law provides that the records you requested from the Department are confidential and not subject to disclosure under the Public Records Law.

Sincerely,

April Warner

Hi April, how many orgs per request would you recommend? (Assuming we are requesting only publicly disclosable records.)

Thanks
Allen

From: allen n

Also, what other agencies in Florida might have records related to our request (that would be publicly disclosable)?

Thanks
Allen

From: Florida Department of Revenue

Mr. Nesbitt,

The Florida Department of Revenue ("Department") does not impose conditions or limit access to the right to request public records.

In our response to you on March 15, 2018, we noted that Florida law [section 213.053(2)(a), Florida Statutes] maintains that taxpayer information contained in returns, reports, accounts, or declarations received by the Department is confidential except for official purposes and exempt from section 119.07(1), Florida Statutes. As indicated in our prior response, to the extent they exist, Florida law provides that the records you requested on March 13, 2018, from the Department are confidential and not subject to disclosure under the Public Records Law. The Department is bound by Florida law to apply the statutory exemption to taxpayer information equally for each organization regardless of the manner in which it receives a public records request.

Sincerely,

Mr. Nesbitt,

The Florida Department of Revenue ("Department") is not able to speak on behalf of other agencies in Florida. The Department is also not aware of each of the statutory exemptions, if any, that may apply to records in the possession of other agencies.
