From:

Beryl,

Thank you for returning my call yesterday. It was nice to meet you. Per our conversation, I'd like to get your written confirmation that the City of Fairfield does not need to disclose the contracts and agreements listed below in response to the Public Records Act Muck Rock submitted on July 23, 2018.

* Property maintenance agreements - where a property owner agrees to maintain landscaping and infrastructure of project that City has approved

* Parks and Recreation Department standard agreements - parents and children sign up for city-sponsored activities and agree to the terms and conditions of participation and City rental agreements for resident use of City facilities.

* Termination of Regulatory Agreements - written document that a previous agreement is terminated

* Right of entry agreements-to inspect or test City or private property for development or use.

* Subdivision Improvement agreements-require the completion of public improvements required by the existing conditions of approval of a development project.

* Memorandums of Understanding between partnering agencies - these are agreements between the City and other public agencies where no money is being exchanged, but instead the parties have agreed to work together for a particular program or activity.

* City employment contracts - the "standard employment contracts" you identified in your original request which include the contracts signed and agreed to when any City employee or independent contractor begin working for the City

As I mentioned on our call, there is a huge number of these agreements. The time it would take the City's staff to find and collect them would be substantial. You acknowledged that these agreements were not the focus of Muck Rock's request, and that it is the organization's primary intent to receive and review contracts where the City is buying services or goods.

In addition, you confirmed that Muck Rock's second request, submitted on August 20, 2018, for "All reports or responsive materials related to pension funds..." was purposely meant to be broad and inclusive, but that you do not have a particular report in mind. Given that, the City, as was always intended, will provide what responsive records it has but does not need to search for a specific report.

I will communicate the same, narrower parameters for the City staff's ongoing search of records unless I receive additional clarification from you before the end of the week.

Thanks so much for your cooperation and patience. City staff will be in touch with the required duplication costs as we approach our first disclosure date for the July 23, 2018 request.
