Data on incidents/crimes reported from 1/1/2009 through 12/31/2020. I am part of a public health research team that is seeking this information for research aimed at reducing violence.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Good afternoon,

Your Request for Public Records dated April 15, 2021, was received in the Office of the City Clerk of the City of Elk Grove on May 4, 2021. This request is seeking records related to incidents/crimes reported from January 1, 2009, through December 31, 2020.

In response to that Request, and pursuant to Government Code section 6253(c), this letter serves to advise you that it appears the Request, in whole or in part, seeks copies of disclosable public records that may be in the possession of the City, as provided by the Public Records Act, Government Code sections 6250 et seq. (the "PRA"). However, the Request may also seek copies of records that are exempt from disclosure under the provisions of the PRA, including, but not limited to, the exemptions set forth at Government Code sections 6254 and 6255.

The City will begin identifying the specific records, if any, which are responsive to the Request, and will make diligent efforts to ensure that all disclosable records will be made available to you as soon as possible. We anticipate that disclosable records can be available by July 2, 2021; if additional time is necessary, we will so notify you.
The City attempts to provide records in electronic format whenever possible to avoid the cost of duplication and mailing; however, should you choose to receive physical copies of any disclosable records, the City will require payment of all costs of duplication, as authorized by Government Code section 6253(b), prior to the release of any copied records. We will contact you in advance if we determine the fees will exceed $50.

Good afternoon,

The City of Elk Grove has identified records responsive to your Public Records Act request dated April 15, 2021, and received in the Office of the City Clerk of the City of Elk Grove on May 4, 2021. This request is seeking data on FBI UCR Part I and Part II incidents reported from January 1, 2009 through December 31, 2020. Specifically, the request specified 34 categories of data including, but not limited to, UCR offense code, bias motivation, type of weapon, force involved, ethnicity of victim and age of arrestee.

Responsive records are attached, except for those records that are exempt from disclosure under Government Code sections 6254(f),(k) and 6255, and Evidence Code section 1040.

Please note that the City has provided (i) an excel sheet that includes the requested data categories that our software is capable of tracking; and (ii) copies of the annual UCR Return A reports that are in City's possession. For the data categories requested that have not been produced, the City's software does not track those categories and such information cannot be produced without manually reviewing and redacting each individual police report. There are over 75,000 police reports for the time-frame requested. Therefore, the City objects to the production of those data categories as unduly burdensome in accordance with Government Code section 6255.

Deputy City Attorney Chelsea Mejia made the determination concerning exemptions pursuant to Government Code section 6253(d).
