Re:  Open Records Request # W131183-051423Dear Mr. Maass:
TheEl Paso Police Department is in receipt of your request referencedabove wherein you asked for "A ll communications, including emails... between the El Paso Police Department and officials from the ChihuahuaGovernor's Office or the Secretaria de Seguridad Pública Estatal..." TheIT Dept. can search for e-mails only by searching each e-mail account. There are about 1, 500 e-mail accounts at EPPD. It takes IT about 30minutes to search each account and upload the results. That’s about 750hours. The fee for this labor is a minimum of $15.00 per hour, so asyou can see this will be quite expensive. If you know the names of thepersons at EPPD who might have knowledge of this subject, we could search just thosee-mail accounts, which would be much less expensive.
Sincerely, Dependingon your response and clarification, it may be necessary for us tocreate an invoice detailing an estimate of time and costs. If theestimate exceeds $40.00, then we will notify you in writing. If theestimate exceeds $100, then under section 552.263 of the TexasGovernment Code, the City will require a deposit of the estimated costsbefore we begin to process the request. Please be advised that pursuantto Section 552.222 of the Texas Government Code, a request forinformation is considered withdrawn if you, as a requestor, do notrespond in writing to this written request for clarification oradditional information within 61 days after that date this request forclarification is sent. Please note that, pursuant to City of Dallas v. Abbott,304 SW3d 380 (Tex. 2010), when a governmental entity requestsclarification or narrowing of an unclear or overbroad request for publicinformation, the ten-day period to request an attorney general opinionas to the applicability of exception to disclosure requirement ismeasured from the date the request is clarified or narrowed.

My apologies in delaying response to this request. Could you please let me know which officers in the El Paso PD are liaisons with counterparts on the Mexican side of the border? I believe we can narrow the request to them and the chief.

Dave
