Pursuant to the Massachusetts Public Records Law, I hereby request the following records:

Any and all details related to car accidents that have been reported in the town of East Longmeadow from the previous year, from January 1st 2022 to December 31st 2022.

Specifically, I am interested in:
- ages of those involved
- location
- time
- day of the week
- number of vehicles involved
- injuries

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Dear Ms. Vaccaro:

On Thursday February 9 2023 we received your request pursuant to the
Massachusetts Public Records Law for the following records:

Any and all details related to car accidents that have been reported in the
town of East Longmeadow from the previous year, from January 1st 2022 to
December 31st 2022.

Specifically:
- ages of those involved
- location
- time
- day of the week
- number of vehicles involved
- injuries

With respect to your request, the Department intends to redact the
following requested records:

All Accidents for the Calendar year 2022

The Department intends to withhold/redact the above-referenced requested
records due to the applicability of the following exemptions and the
reasons set forth below:

Exemption (c): This exemption applies to "personnel and medical files or
information and any other materials or data relating to a specifically
named individual, the disclosure of which may constitute an unwarranted
invasion of personal privacy; provided, however, that this sub clause shall
not apply to records related to a law enforcement misconduct
investigation." The records requested contain medical files and/or
information which must be withheld/redacted from the records pursuant to
this exemption. The records requested contain information which, if
disclosed, would constitute an unwarranted invasion of personal privacy.
Such information contains intimate details and the privacy interests
involved outweigh the public interests in the disclosure of that
information. In making that determination, the department has considered
the following factors: (1) whether disclosure would result in personal
embarrassment to an individual of normal sensibilities; (2) whether the
materials sought contain intimate details of a highly personal nature and
(3) whether the same information is available from other sources. As a
result, such information must be withheld/redacted under the law.

In order to comply with your request, the total reasonable fee of $145.80
will be charged. This fee must be paid in full prior to the requested
records being provided by check payable to The Town of East Longmeadow. The
total fee has been calculated as follows:

Search and Segregation Costs:

The lowest paid employee who has the necessary skill to complete the search
and segregation is the Administrative Clerk whose hourly rate is $24.30. In
order to comply with your request, it will take approximately 6 hours of
search and segregation time, based upon the following: copy and redact 444
accident reports resulting in a fee of $145.80.

Please be advised that pursuant to 950 CMR 32.00 and G.L. c. 66, section
10A(a) you have the right to appeal this decision to the Supervisor of
Public Records within 90 calendar days. Such appeal shall be in writing,
and shall include a copy of the letter by which the request was made and,
if available, a copy of the letter by which the custodian responded. The
Supervisor shall accept an appeal only from a person who had made his or
her record request in writing. Pursuant to G.L. c. 66, section 10A(c), you
also have the right to seek judicial review by commencing a civil action in
the superior court.
