Pursuant to the New York State Freedom of Information Law, I hereby request that the following records be emailed to me, if possible:

(a) any and all correspondence, including text messages and emails, sent or received on May 26, 2017 by Police Chief Chris Lavin pertaining to (i) a memorandum of understanding ("MOU") or "agreement regarding thefts at Walmart stores in Brunswick and East Greenbush," as Rensselaer County District Attorney Joel Abelove reportedly described it in a separate memorandum, (ii) the Albany Times Union, or (iii) Walmart.

(b) any and all records created since January 1, 2016--including incident or arrest reports--pertaining to the Walmart Supercenter on 279 Troy Road. You may redact Social Security numbers or other details that, if disclosed, would constitute unwarranted invasions of personal privacy.

For reference or to assist your search for responsive documents, the following news articles were published by the Albany Times Union on May 26, 2017:

Please note that statistical or factual tabulations or data; instructions to staff that affect the public; and final agency policy or determinations cannot be withheld from the public under Section 87(2)(g) of the Freedom of Information Law.

If my request is too broad or does not adequately describe the Records, please contact me so that I may clarify my request, and when appropriate inform me of the manner in which Records are filed, retrieved or generated.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

In reply to your request, there are approximately 720 incidents/arrests at the Wal-Mart location for the period 1/1/2016 to present. Response to your request at .25 per page is estimated at $180. plus postage. Records are printed and sent via US Mail.

And (2) can you please trim the date of my request, so that incidents/arrests date from only May 1, 2016 to the present, and advise of the revised, estimated cost? Thank you for your assistance.

A modified date of 5/1/2016 brings the count to 569 records and a cost of $142.25 and includes all incidents and arrests. May I suggest, if you are specifically interested in arrests for "shop lifting" (Petit Larceny), that you reword your request. There are 151 such cases 1/1/2016 to present. ($37.75 plus postage). Just a suggestion.

Yes, thanks, I will follow your suggestion. That is: petit larceny only--but can you also limit it to 5/1/16 to the present? Then please let me know if I need to do anything else besides consent to have the request processed.
