To Whom It May Concern:

Pursuant to the Massachusetts Public Records Law, I hereby request the following records:

I request the Dracut Police Department produce any and all records relating to internal affairs complaints against Dracut Police Department officers between January 1, 2005 - August 17, 2020, this information shall including but not limited to the following:
1. Police Officer's Full Legal Name (including Given/First Name and Last/Surname);
2. Rank;
3. Badge Number;
4. Date of IAD complaint;
5. IAD Complaint # (sometimes referred to as the Complaint Control Form #);
6. IAD Case # (this is the number assigned to the IAD investigation file);
7. Nature of Charges against the Officer;
8. Results of the IAD investigation; and
9. IAD Complaint Disposition Date.

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

Sincerely,

Records Requester

We are forced to once again appeal the unsupported fees quoted by the record holder. While we appreciate Mr. Chantrads’ responsiveness to our request. The record holder, Dracut Police Department, has not provide the records we originally requested on August 9, 2020. Mr. Chantrads' latest response letter dated November 3, 2020 quotes the same fee estimate as his earlier response dated September 23, 2020, which the Secretary of the Commonwealth found lacked "sufficient explanation". No further adequate explanation has been provided. Further the record holder, Dracut Police Department, is still attempting to assess a fee for time spent segregating or redacting records, but has not petitioned the Supervisor nor shown that this redaction or segregation is required by statue.

Good Afternoon,

Earlier today I contacted the Secretary of State's office regarding your request.

Lieutenant Ware and I had hoped to send a revised cost estimate by this afternoon. Due to Covid 19 related issues, we have asked the Secretary of State's office for a time extension to produce a revised cost estimate.

I appreciate your time and patience.

Deputy Chief Michael Want

From: Dracut Town Clerk (MA)

Good Afternoon,

Please disregard my last email, it was not well written.

I should be clear, I did not file for an official extension. I contacted the Secretary of State's office to let them know we needed more time due to a Covid 19 related issue.

The reason I contacted both parties was to make sure you knew we are working on it.

We plan on having the revised cost estimate completed next week, hopefully by December 17th.

Thank you again.

Deputy Chief Michael Want
