To Whom It May Concern:

Pursuant to Delaware's Freedom of Information Act, I hereby request the following records:

The data record layout, data frame, or any equivalent data framework used by this agency to document maternal deaths. Materials responsive to this portion of this request should include reference to the data elements collected by this department and should not include any personal information. Please feel free to redact any personally-identifying information.

Good Day -
This email is to acknowledge that your FOIA request was forwarded to us the Department of Health and Social Services and was received by the Delaware Department of Safety and Homeland Security (DSHS) on October 19, 2017, seeking data on maternal deaths. Please note that FOIA allows access to "public records," unless the public record requested falls within one of the enumerated statutory exemptions. See 29 Del. C. §10002 (definition of "public record" and specific exemptions); 29 Del. C. § 10003 (setting forth FOIA request procedures). Your request has been sent for legal review and will be subject to review in an effort to determine if we possess any responsive records. We will provide an update within 15 business days. Thank you.

From: Department of Health and Social Services

Good Afternoon -

The Department has reviewed your request and determined that no responsive documents exist to your request. The law does not require a public body to create a record that does not exist (see, e.g., Del. Op. Att'y Gen. 15-IB17 (June 17, 2015)), nor does it require a public body to prepare an accounting from various sources and arrange it in a requested format to create a new public record that did not previously exist (see, e.g., Del. Op. Att'y Gen. 05-IB08 (Apr. 4, 2005)).
However as a courtesy I have copied Anne Pedrick, from the Child Death Review Commission, who may have information responsive to your request. The DSHS considers your request closed.

Thank you.

Re: FOIA Request - Lustig, Adanya (maternal deaths data frame)

Dear Adanya,

This email is to acknowledge that the Delaware Division of Public Health (DPH), located within the Delaware Department of Health and Social Services (DHSS), received your Freedom of Information Act (FOIA) request dated Oct. 19, 2017 as a forward from the Dept. of Natural Resources and Environmental Control on October 17, 2017. You requested:

"The data record layout, data frame, or any equivalent data framework used by this agency to document maternal deaths."

In order to better process your request, we request the following clarifying information: Are you looking for the number of maternal deaths in the State of Delaware in a given year? If so, what years? Or, are you looking at what method is used to collect that data?

Once we have your response, per Delaware statute, please allow for up to 15 business days for us to process your request. Thank you for your FOIA request to the Division of Public Health.

Sincerely,

Andrea Wojcik

Hi Andrea,

Thanks for getting back to me! I'm looking for what kind of data the DHSS tracks on maternal deaths, not actually the data itself. For example, whether maternal deaths are tracked by region, marital status, etc. Does that make sense?

Best,
Adanya

Good afternoon,

I am not entirely clear on what you are asking for in your request. Delaware’s Maternal Mortality Review process is housed within the Child Death Review Commission. The 2016 annual report which includes a Maternal Mortality section can be located at the website listed below my name under “reports”. In addition, you can access the Maternal Mortality Policy which is located under the “tools/resources” tab. This policy describes the process and type of data that is gathered.

Please let me know if this is what you are looking for in your request.

Thank you.

Re: FOIA Request - Lustig, Adanya (maternal deaths data frame)

Dear Adanya,

This email is in response to your Freedom of Information Act (FOIA) request dated Oct. 19, 2017 as a forward from the Dept. of Health and Social Services on October 17, 2017. You requested:

"The data record layout, data frame, or any equivalent data framework used by this agency to document maternal deaths." In response to my email of Oct. 23, 2017 requesting clarification, you responded:
"I'm looking for what kind of data the DHSS tracks on maternal deaths, not actually the data itself. For example, whether maternal deaths are tracked by region, marital status, etc."

The Division of Public Health does not track maternal deaths specifically. To that end, the Division has no responsive records. The Vital Statistics program collects data from death certificates. The data elements include everything that is in the death certificate (i.e. all the demographic data and causes of death (COD)). The literal COD are translated into ICD (International Statistical Classification of Diseases and Related Health Problems) codes. Using the ICD codes, vital statistics staff can pull records with causes of death associated with maternal death.

However, the state's Child Death Review Commission under the state Office of the Courts has a Maternal Mortality Review process that can be found described here: https://courts.delaware.gov/childdeath/typesofdeath.aspx. For additional information on the MMR, contact Executive Director Anne Pedrick at anne.pedrick@state.de.us<mailto:anne.pedrick@state.de.us> .

Unless you have additional questions about this specific FOIA request, the Division considers your request closed at this time. Thank you for your FOIA inquiry to the Division of Public Health.

Sincerely,
