The Department has reviewed your request and determined that no responsive documents exist to your request. The law does not require a public body to create a record that does not exist (see, e.g., Del. Op. Att'y Gen. 15-IB17 (June 17, 2015)), nor does it require a public body to prepare an accounting from various sources and arrange it in a requested format to create a new public record that did not previously exist (see, e.g., Del. Op. Att'y Gen. 05-IB08 (Apr. 4, 2005)).

Hi Andrea,

Thanks for getting back to me! I'm looking for what kind of data the DHSS tracks on maternal deaths, not actually the data itself. For example, whether maternal deaths are tracked by region, marital status, etc. Does that make sense?

The 2016 annual report which includes a Maternal Mortality section can be located at the website listed below my name under “reports”. Dear Adanya,

This email is in response to your Freedom of Information Act (FOIA) request dated Oct. 19, 2017 as a forward from the Dept. of Health and Social Services on October 17, 2017. You requested:

"The data record layout, data frame, or any equivalent data framework used by this agency to document maternal deaths." In response to my email of Oct. 23, 2017 requesting clarification, you responded:
"I'm looking for what kind of data the DHSS tracks on maternal deaths, not actually the data itself. For example, whether maternal deaths are tracked by region, marital status, etc."

The Division of Public Health does not track maternal deaths specifically. To that end, the Division has no responsive records. The Vital Statistics program collects data from death certificates. The data elements include everything that is in the death certificate (i.e. all the demographic data and causes of death (COD)). The literal COD are translated into ICD (International Statistical Classification of Diseases and Related Health Problems) codes. Using the ICD codes, vital statistics staff can pull records with causes of death associated with maternal death.

However, the state's Child Death Review Commission under the state Office of the Courts has a Maternal Mortality Review process that can be found described here: https://courts.delaware.gov/childdeath/typesofdeath.aspx.
