Pursuant to the Delaware Freedom of Information Act, I hereby request the following records:

I seek all records concerning any contracts, agreements, memoranda of understanding, or other written instruments between the state of Delaware and Amazon or any other subsidiaries regarding the following Amazon fulfillment centers, including but not limited to any agreements concerning taxation or the provision of any municipal resources:

This email is in response to the FOIA request received on August 22, 2023. See the request attached.

In Delaware, the Freedom of Information Act (FOIA) provides access to public records for citizens of the State of Delaware. Accordingly, because you do not appear to be a Delaware citizen, you do not have the guaranteed right under FOIA to access State of Delaware public records. See McBurney v. Young S.Ct. 1709 (2013): see also Del. Op. of the Attn'y Gen. 16-IB20 (Sept. 30, 2016) (finding that the denial of a FOIA request by a non-Delaware citizen was not a violation of FOIA because the word "'citizen', as used in section 10003(a), refers to citizens of the State of Delaware.").

As the right to access documents pursuant to FOIA is not guaranteed for non-Delaware citizens, the Department of State is denying your request.

With this response, the Delaware Department of State considers your request closed.
