Pursuant to the Texas Public Information Act, I hereby request the following records:
• A copy of the bid submitted by Dallas in response to Amazon's request for proposals for the site of its second headquarters — document(s) which would have been sent between September 1, 2017 through January 20, 2018 — and any supplemental materials provided to Amazon at the same time.
When we requested this bid previously, your office denied our request via section 552.104 of the Government Code, which exempts “information that, if released, would give advantage to a competitor or bidder.”
The letter said “The city states it has specific marketplace interests in the information at issue because the city is competing with other cities to attract the named company” — referring to Amazon — “to develop a site for its headquarters within the city.” However, now that Amazon has decided on the site of its second headquarters, Dallas is no longer in competition with other cities in this regard and the document should be subject to public disclosure.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
