Pursuant to the Connecticut Freedom of Information Act ("FOIA"), I hereby request the following records:

--Records describing "parallel construction" or policies that are effectively the same.
--Records referencing the 1938 Supreme Court case, Scher v. United States.

"Parallel construction" is a strategy used by some law enforcement agencies, including the Drug Enforcement Administration. http://www.reuters.com/article/2013/08/05/us-dea-sod-idUSBRE97409R20130805. Under "parallel construction," when law enforcement agents are presented with evidence that was obtained using a search that the government wants shielded from judicial or public review, it effectively covers up that initial search by coming up with other reasons to stop, search, or seize the suspect. "Parallel construction" may be justified by a 1938 Supreme Court case called Scher v. United States. See https://muckrock.s3.amazonaws.com/foia_files/1-23-14_MR6434_RES_ID13-00541-F_1.pdf at 155.

I also request that, if possible and pursuant to Conn. Gen. Stat. ยง 1-212(d), fees be waived as I believe this request is in the public interest and not made for commercial gain. The requested documents will be processed by a representative of the news media/press and made available to the public at MuckRock.com.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 4 business days, as the statute requires.

Dear Avinash Samarth:

In response to your FOI request concerning parallel construction, please be advised that there is no reference to the term "parallel construction" anywhere in the Conn. State Police A & O (administrative & operation) Manual which contains the department's policies and practices. We searched some other areas as well and did not find anything with that term or policies that are effectively the same. As such, we do not have any documents responsive to your request. The same is true with respect to your request for records referencing the 1938 Supreme Court case you cite.
