Hello,

I am seeking any, and all documentation relating to the decision to suspend Isiah Elliott.

I am specifically requesting any, and all e-mails, written documentation, requests with district attorney(s), any and all communications as it relates to the request, including formal complaints with the district and their written responses to complainants.

The sources of these request should primarily be with district administration, school staff, superintendents, assistant superintendents, Grand Mountain School staff [all emails from {any} staff re: this request], Webmaster {Tyler Ronde}, Any police communication, Executive Directors and any and all other offices which have documentation, emails, or other correspondence relating to this request.

We received your Colorado Open Records Act request in the mail on Tuesday,
May 18, 2021. Your request is denied.

The records you have requested are either protected by Family Educational
Rights and Privacy Act (“FERPA”), 20 U.S.C. sec. 1232g, attorney-client
privilege, or do not exist. The FERPA rules clarify that records that are
maintained by the school district and contain personally identifying
information about a student are protected as educational records. 34 CFR
99.03. Your request does not fall within the exceptions listed in 34 CFR
99.31 or CRS 24-72-204(3)(e) or any other rule.

Regarding records of communications between the District and its attorneys,
these are covered by the attorney-client privilege. The custodian of
records may not disclose privileged information. CRS 24-72-204(3)(a)(IV).

We find no records that would be responsive to your request that exist or
are not protected, either by FERPA or by the privilege.
