In response to your public records requests for:
“Any and all records, correspondence (including email), internal documents, technical specifications, project plans, budget projections, proposal documents and documents related to bids and potential bids related to the Safe Smart CLE program, LED street lighting, and the integration of LED light based cameras into Cleveland Public Power of Department of Police systems.”
This request is overbroad and seeks a complete retrieval and duplication of every physical and electronic document and communication that is arguably directly or indirectly related to a multi-departmental City project. See State ex rel. Dehler v. Spatny, 127 Ohio St.3d 312, 2010-Ohio-5711, ¶¶1-3. Further, the request does not identify the requested records with sufficient clarity as required in State ex rel. Dillery v. Icsman (2001), 92 Ohio St.3d 312, 314-315 and State ex rel. Glasgow v. Jones, 2008 – Ohio 4788, 119 Ohio St.3d 391 at ¶17.
The Ohio Supreme Court has determined that requests for a duplication of all records having to do with a particular topic, or all records of a particular type are overly broad. See, e.g. State ex ref. Zidonis v. Columbus State Community College, 133 Ohio St.3d 122, 2012-0hio-4228 (request for all litigation files and all grievance files for a period over six years, and for all emails between two employees during joint employment); State ex rel. Without greater specificity, the City is unable to determine which records are being sought and would be required to speculate as to the extent of what might conceivably be “related” to the subject matter of the request, then duplicate all internal and external records and communications held by all City Departments that fall within those parameters. I reviewed the request you submitted, it was withdrawn due to part of the request is denied because the Ohio Revised Code 149.433 exempts security and infrastructure records. The overall request is too broad and vague. Request needs to be more specific.
