RE: Open Records Request of January 03, 2024, Reference # C002841-010324

Dear Mr./Ms. MuckRock News,

The City of Cincinnati received a Public Records Request from you on January 03, 2024. After reviewing your request, we require further clarification in order to process your request.

Your request is not a proper request under Ohio public records law because the standards for a proper public records request are distinctly different than the standards for a discovery request.  A public records request asking for records "regarding or relating to" a topic is improper as a public records request.  Decrane v. City of Cleveland, 2018-Ohio-3651, Court of Claims Case No. 2018-00358PQ, ¶ 6, citing State ex rel. Thomas v. Ohio State University, 71 Ohio St. 3d 245, 1994-Ohio-261.  Similarly, a request for "all records" fails to identify the records sought with sufficient clarity.  Id. See also Ebersole v. City of Powell, 2018-Ohio-4597, Court of Claims Case No. 2018-00478PQ, ¶¶ 22-23.

As written the request would require the City to interpret your intent rather than simply retrieve specific records.  In short, your request is drafted as a discovery request, not a public records request.  If you would like to revise your request to specifically identify the records being sought, the City will search for and retrieve any responsive records. If you have questions regarding how the City keeps its records so that you can narrow your request, please let me know.
Please reply within ten (10) business days or your request will be closed, and you will be required to submit a new request.

You can reply to this email with your clarification or send a message by logging into the City of Cincinnati Public Records Center.

Once we receive additional clarification information we can begin working on your request.

Thank you.
