Any and all email communications between any member of your agency and any employee or contractor of Motorola Solutions or any related business entity between the years of 2018 and 2023, to include but not be exclusive to emails from the @motorolasolutions.com domain.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

This request is not a proper request under Ohio public records law because the standards for a proper public records request are distinctly different than the standards for a discovery request. “ A discovery-style demand to conduct an officewide search for records containing information ‘regarding or related to’ an agency, program or person is improper as a public records request.” Decrane v. City of Cleveland, 2018-Ohio-3651, ¶ 6 (Ct. Cl.), citing State ex rel. Thomas v. Ohio State University, 71 Ohio St. 3d 245, 1994-Ohio-261.  Similarly, a request for “any and all email communications…” fails to identify the records sought with sufficient clarity . Id. See also Ebersole v. City of Powell, 2018-Ohio-4597, ¶¶ 22-23 (Ct. Cl.). A request for “ Any and all email communications between any member of your agency and any employee or contractor of Motorola Solutions or any related business entity between the years of 2018 and 2023, to include but not be exclusive to emails from the @motorolasolutions.com domain is improper under this standard. As written the request would require the City to interpret the intent of the requestor rather than retrieve specifically identified records. We request you revise the request within 10 business days, and after that if we have not received a response we will consider the request closed and a new request will have to be submitted.
